In light of the email below and discussion I had with Chris Underwood this afternoon, it appears that a site visit to Cates Farm with everyone included in this email is a bit premature. Instead, I will reiterate my previously submitted comments about the site as well as a consolidation of comments regarding the mitigation plan emailed by HDR in September 2015. It is my understanding that those comments will suffice for DOT's planning purposes at this time, given the proposed Let date currently set for post -2020. Closer to the Let date, and once DOT has addressed the below and attached comments, a site visit similar to the one previously proposed may be appropriate. D. Bailey site visit (February 2015) comments: See attached email from 2/3/2015. Mitigation Plan Comments: See below and also attached "Cates Farm Mit Plan Map Comments.pdf" -Generally it seems that some of the ratios being applied and required monitoring have not been consistent with what has been required of NCDMS/Banks; -Some of the ratios that are proposed don't seem to reflect the potential uplift base on the work that will be done (Reach 1, 1.5:1 for Ell work, Mill Creek 10:1 for one -side stream preservation, Reach 4 and 5 for invasive removal); -One-sided stream preservation is likely problematic; -Only visual monitoring is proposed for vegetation plantings; -DOT has 5:1 on all of their currently active preservation sites, 4:1 on a large site along US19. Preservation should be documented as being high quality (NCSAM) and to warrant 5:1 ratio; -IRT is generally not accepting preservation for one-sided streams, a situation with a right-of-way limitation could be ok; that does not appear to be the case with this project; - Ell for only removing exotics and 1:1.5 for no bank work is generally not appropriate, although perhaps a really bad infestation of exotics could warrant Ell ratios (% cover of each invasive species for each Reach would be helpful for evaluation). -Section 2.0: appears that 7,980 should be 7,982 I.f. of stream; -Reach 1: A more thorough accounting of invasive problem (e.g. % cover, some other unit of measure) is warranted for justification. Will the previous farm crossing be removed from mitigation area/credit production? "Moderate degradation" warrants further explanation. -Reach 2: Are cattle still present along reach? -Reach 4: Is the Duke Power easement removed from mitigation area/credit production? How is Unique Places, LLC involved in this project? -Reach 6: Last sentence on Pg. 4 is confusing. -Reach 7: Are there NCSAM forms to document quality of the stream reach? -Mill Creek: What is proposed to be done about the beaver dams along the reach? What types of mussels occur along the reach? -Section 3.0: What specifically is meant by "NCDOT will manage the Site to prohibit all use inconsistent with its use as mitigation property"? Is there a Conservation Easement or other protection instrument? -Section 4.0: Note that invasive treatment is generally only of limited value for enhancement. Are encroachments into proposed conservation areas happening currently? i.e. cattle/ATV use ongoing? -Section 5.0: Are the riparian buffer areas proposed for planting already wooded? Which species would be planted? -Section 6.0: How would NCDOT monitor buffer vegetation survival? Plots? What success criteria are proposed? -Section 7.0: Is visual monitoring the only form of monitoring proposed for vegetation? -Section 8.0: Regarding potential future property purchases, would NCDOT procure these properties simply for mitigation? -Section 9.0: We note that a 100% up front credit release is proposed; -Section 10.0: The statement " Any remaining credits will be available for use for other impacts within HUC 03030002" is problematic. NCDOT is only acquiring this area now as part of a required early acquisition of right of way for the road project within a protected corridor. The road project is not scheduled to let until December 2031. Our goal in having an agency review of the site is to document existing conditions of the streams and wetlands and discuss possible mitigation scenarios. Other areas within the property may end up in a protective easement also in the future, such as the opposite side of Mill Creek. We were not expecting to set mitigation ratios or use this site as mitigation at this time since the project is so far in the future. We would appreciate any feedback about the mitigation potential based on the current conditions and uses of the streams and wetlands on the site if acquired and placed in a protective easement.
