The project improvements extend from west of SR 1801 (Liner Cove Road) to north of SR 1523 (Old Clyde Road) near Lake Junaluska. There will be 308 linear feet of permanent impacts (Modified to 313 linear feet) and 0.03 acre (101 linear feet) of temporary impacts (Modified to 121 linear feet) to jurisdictional streams. In addition there will be 0.01 acre of impacts to wetlands associated with mechanized clearing. There will be <0.01 acre of temporary impacts to a jurisdictional stream associated with an open cut of an umramed tributary to Richland Creek in order to install a water line near Permit Site 3. The project is currently under construction. Due to the skew of an existing headwall (Permit Site 6), and limited shoulder width for guardrail installation, NCDOT is proposing to modify the subject permit (Permit Site 6). The original plan sheets showed the extension of the existing headwall approximately 4 feet high to accommodate the rise in grade elevation along the new alignment of US 23 Business. However, due to the skew of the existing headwall, the new headwall would reduce the new shoulder width resulting in a conflict with the installation of new guardrail along US 23 Business. In order to correct the problem, NCDOT proposes to extend the inlet end of the 48" culvert 5 linear feet and re -skew the headwall perpendicular to the stream to provide adequate shoulder width to meet NCDOT roadway standards. All work will be conducted within NCDOT right of way. I am enclosing a revised PCN Impact Table, plan sheet for Permit Site 6 showing the proposed work, photographs and a marked county map and USGS topographic map. No trees will be cut, which will eliminate any potential impacts to Indiana and Northern long-eared bat summer roosting habitat. In addition, the NCWRC did not require a trout moratorium on this project (letter dated February 6, 2014). No additional stream mitigation will be required for this modification. Permits Requested NCDOT is hereby requesting authorization under Section 404 of the Clean Water Act to proceed with the subject modification outlined above. By copy of this letter, I am asking Mrs. Marla Chambers, Western NCDOT Coordinator with the North Carolina Wildlife Resources Commission (NCWRC), to comment directly to you concerning the 404 Nationwide Permit request. Also, by copy of this letter, I am requesting authorization under Section 401 of the Clean Water Act from the North Carolina Department of Environmental Quality (NCDEQ), Division of Water Resources (DWR). In addition, I am asking Ms. Chambers and Mr. Ben DeWit, EI, Roadside Environmental Field Operations Engineer (NCDOT), to comment directly to me concerning this permit request.
