The Division of Water Resources (DWR) has performed a review of a 401 Water Quality Certification application dated
April 14, 2016 and received by DWR on April 25, 2016 for the above referenced project. The DWR has determined that
your application is incomplete and cannot be processed. The application is on -hold until the following information is
received:
Please provide a signed agent authorization letter from the owner or an easement agreement between the
property owner and the Town of Black Mountain. [15A NCAC 02H .0506(f)]
Per Water Quality General Certification No. 3890, this project is required to provide a stormwater management
plan (SMP) to protect water quality (regardless of project area or amount of impervious area). Please see
Appendix A of the General Certification, available here, and submit a plan that is in accordance with low density
project stormwater requirements. Alternatively, you may provide a copy of the locally reviewed SMP with proof
of approval if the jurisdiction is certified for 401 stormwater management plan reviews. [15A NCAC 02H
.0506(b)(5) and (c)(5)]
Pursuant to Title 15A NCAC 02H .0502, the applicant shall furnish all of the above requested information for the proper
consideration of the application. If all of the requested information is not received within 30 calendar days of receipt of
this email, the DWR will be unable to approve the application and it will be returned. The return of this project will
necessitate reapplication to the DWR for approval, including a complete application package and the appropriate fee.
