Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. For administrative and distribution purposes, the USACE requires information to be submitted on sheets no larger than I 1 by 17-inch format; however, DWQ may accept paperwork of any size. IV. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USAGE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Provide photocopies of previously issued permits, certifications or other useful information. Describe previously approved wetland, stream and buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project, list and describe permits issued for prior segments of the same T.I.P. project, along with construction schedules. No prior permits have been requested. Proposed Impacts to Waters of the United States/Waters of the State It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the project. Each impact must be listed separately in the tables below (e.g., culvert installation should be listed separately from riprap dissipater pads).. Be sure to indicate if an impact is temporary. All proposed impacts, permanent and temporary, must be listed, and must be labeled and clearly identifiable on an accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial) should be shown on a delineation map, whether or not impacts are proposed to these systems. Wetland and stream evaluation and delineation forms should be included as appropriate. Photographs may be included at the applicant's discretion. If this proposed impact is strictly for wetland or stream mitigation, list and describe the impact in Section VIII below. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were, minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Extensive avoidance and minimization techniques are practiced throughout the site. All wetland impacts will be avoided. Phased development clusters, including single- and multi-family homes, are located between Neuse-buffered streams. At the road crossings, headwalls will limit the length of the culverts, and the culverts are designed to match the existing stream profiles in order to reduce the length of the required riprap dissipators. Jack and bore techniques will be used to reduce the impacts of utility line crossings. All unnecessary crossings were avoided in designing the site. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USAGE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USAGE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina (see DWQ website for most current version.). 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a • Updated 11/1/2005 Page 10 of 13 description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. Mitigation will be provided through payment-in-lieu program with NCEEP (see below 2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement Program (NCEEP). Please note it is the applicant's responsibility to contact the NCEEP at (919) 715-0476 to determine availability, and written approval from the NCEEP indicating that they are will to accept payment for the mitigation must be attached to this form. For additional information regarding the application process for the NCEEP, check the NCEEP website at http;//www.nceep.net/pages/inlieureplace.htm. Proposed maximum built-out impervious is 24% of 422.60 acres which is 101.42 acres. All stormwater discharges will be diffuse flow and peak most-development flows will match pre-development XII. Box 51806 Durham, North Carolina 27717 • (919) 490-4990 SIERRA PRE-CONSTRUCTION NOTIFICATION SECTION 401 /404 PERMIT AND NATIONWIDE 29 PERMIT APPLICATION NARRATIVE General Description Sierra is a proposed 422.60-acre subdivision located between the northeast intersection of Doc Nichols Road and Leesville Road and the southeast corner of Doc Nichols Road and Olive Branch Road in Durham, North Carolina. It will consist of single-family homes and town homes and is zoned PDR 3.0. The site is located along Earthquake Creek and is located in the Neuse River Basin. Earthquake Creek is classified by US Army Corps as a perennial stream, and the majority of its tributaries on the site are unimportant intermittent streams. This project is a phased design. Construction-level design documents are being reviewed by the City of Durham for only the infrastructure construction, including Athena, Atlas, and Bowhall roads. Phased pods of single- and multi-family units will be designed at a later date. However, this permit application will address the impacts created in the anticipated built out condition. Pre-Construction Notification Narrative (This narrative follows the structure of the attached North Carolina PCN Addendum.) Section 1: Processing The permit under consideration is a Nationwide 29 Permit, administered by the US Army Corps and a 401 /404 Water Quality Certification issued by NC DWQ. Mitigation is required only for Zone 1 buffer impacts where utility lines are parallel to a stream; payment to the North Carolina Ecosystem Enhancement Program (NC EEP) is proposed. Acceptance into the In-Lieu Fee program has been obtained, and the acceptance letter is attached.. Other buffer impacts include those associated with areas where the proposed connector road crosses the intermittent and perennial streams and the bypass channels associated with the nutrient reduction facilities. The nutrient reduction facilities are primarily pocket wetlands and they are chosen instead of level spreaders because of steep slopes on the site. • Section 2: Applicant Information The applicant, East Durham Land Company, LLC, has authorized Horvath Associates as their agent with an agent authorization form. The signed agent authorization is included in this application package. The contact information for both parties is included on the PCN. Section 3: Project Information The following maps are attached: USGS, NRCS Soil Survey, vicinity map, construction drawings (24x36 full size plans), drainage map (24x36 full size plans), and impact maps. (8.5x1 1 sheets). All stream impacts and buffer impacts appear on the impact maps. There are two culvert crossings on the site. Culvert details are shown on the impact maps and the culvert design profiles (attached). Velocity dissipators are shown on the impact maps, and calculations are attached. There are no stream relocations on the site. The portion of the DWQ Stream Classification List pertinent to this project is attached. Lick Creek is the nearest receiving stream; some of the site drains to Martin Branch, which drains to Lick Creek, too. Martin Branch is not included in the DWQ Stream Classification List. It is important fo note that this project is presented in two phases. The initial phase is construction of the primary road through the project. Each discharge point is designed and will be constructed as a permanent structure even in cases where the facility will eventually be abandoned and replaced with a facility in a future sub-phase. Each proposed stormwater facility will function as a constructed wetland and will provide 1-year peak flow attenuation in order to satisfy City of Durham Detention requirements. The second phase presented shows the future site plan build-out,and shows the pocket wetland associated with each phase. These wetlands are designed to be the final BMP in place. Section 4: Prior Project History Copies of two stream determinations are attached. Section 5: Future Project Plans Even though the fully developed, built-out condition is not shown on the impact maps (it will be designed in the future), all anticipated impacts are shown. The owner reserves the right to apply for future impacts based on unanticipated conditions. Section 6: Proposed Impacts to Waters of the US The proposed impacts include two culvert crossings (one over unimportant intermittent stream and the other over perennial stream), nine utility line crossings (five over intermittent stream, three over perennial stream, and one over both), and two fill locations (crossing will be avoided, only buffer impacts). Some of the buffer impacts are by sanitary sewer that will travel parallel to the stream, and some are by perpendicular crossings. All perpendicular utility crossings across perennial stream will use jack and bore techniques to avoid perennial stream impacts. Additionally, temporary buffer impacts will be created by a temporary diversion channel to facilitate the installation of the Atlas box culvert. Summaries of the buffer and stream impacts are attached. All onsite streams have been subject to a stream determination by NC DWQ. Steep slopes are pervasive on the site and there are no discharges points where the slopes are flat enough to accommodate level spreaders. For this reason, all points of discharge will be treated for nutrient removal with pocket wetlands. The wetland designs adhere to all aspects of the latest North Carolina Division of Water Quality Best Management Practices Manual (BMP Manual). The resulting maximum discharge from each wetland ranges from 0.02 cfs to no more than 0.13 cfs at each discharge point. The result is that the peak outflow resulting from the 1-inch rainfall will produce little or no erosion. Section 7: Avoidance and Minimization Extensive avoidance and minimization techniques are practiced throughout the site. Wetland impacts do not exceed those impacts necessary to install sanitary sewer in order to connect to the regional sanitary sewer pump station. Additionally, the individual pods and phases of the subdivision, including single- and multi-family homes, are located between the streams with Neuse buffers. As a result, only two stream crossings are currently planned. Lot layouts avoid all wetlands and stream buffers on the property. The Atlas stream crossing (perennial) is 105 degrees and the Athena stream crossing (intermittent) is 66 degrees. While the Athena crossing is less than 75 degrees, the crossing occurs near a 90-degree bend in the stream. The situation of the road parallel to the stream buffer allows for an avoidance of impacts, and the crossing's location avoids impacting a nearby intermittent tributary (to the north-northeast), while allowing for adequate space to develop pods of lots. Headwalls are used on each crossing to minimize impacts, but due to the steep grades around the streams, a balance is proposed to minimize the potential safety hazard created by excessively high walls. The use of phasing and pod design also encourages smart erosion and sediment control. The site will be developed in small sections, which will minimize the sediment impact at any one time. Greater attention to maintaining erosion controls can be given to the smaller phases as they are built, too. Section 8: Mitigation Approval from NCEEP of the mitigation required is attached. The project will use the payment-in-lieu program for a total of 3,201 square feet of buffer impacts: 3,201 SF in Zone 1 and 0 SF in Zone 2. The perennial stream impact is less than 150 linear feet, so no stream mitigation is required. The buffer impacts that entail mitigation include utility lines parallel to the stream that encroach into Zone 1 of the Neuse buffers. The total amount of mitigation required (with multipliers) is 9,603 SF. The mitigation will be handled by "Payment into the Riparian Buffer Restoration Fund." All other buffer impacts are 'allowable' and do not require mitigation. Section 9: Environmental Documentation No federal funds will be used, and no NEPA/SEPA documents are required Section 10: Proposed Impacts on Riparian and Watershed Buffers (see Section 8 and Section 1 1) Given that level spreaders are not feasible for any discharge point on the site, each discharge point will be treated with pocket/constructed wetlands to meet alternative nutrient removal requirements. Each wetland will be designed per the latest North Carolina Best Management Practices Manual (NC BMP) and to the latest City of Durham standards. City of Durham Stormwater Services will review each wetland for compliance with water quality standards and City of Durham requirements. Nitrogen treatment is not required, because the final site imperviousness will not exceed 24 percent. The nitrogen loading rate is less than 3.6 pounds per acre per year, based on the City of Durham's nitrogen loading calculation methods. All buffers appear on the plans, including 50' North Carolina Neuse Basin buffers and 100' City of Durham perennial stream Neuse buffers. • Section 11: stormwater There is no existing impervious area on the site. The overall site is limited to 24% impervious in the post-development, fully built-out condition. City of Durham is responsible for implementation and review of all aspects of the stormwater management plan, including adherence to the Neuse Buffer rules (NSW) and water supply watershed rules (WS IV). The August 20, 2007 memorandum to this effect is attached. All construction document approvals associated with the stormwater management plan will be forwarded to NC DWQ upon receipt. Two of the proposed `pods' are currently slated for multi-family town homes. Each of these pods is to be treated for 85~o TSS removal in the post-development condition. Section 12: Sewage Disposal Sewerage generated by the proposed development will be piped into the City of Durham sanitary sewer system and treated. Section 13: Violations This site is not in violation of DWQ Wetland Rules or any Buffer Rules. Section 14: Cumulative Impacts This project, based on past and reasonably anticipated future impacts, will not result in additional development that could affect water quality. Sullin Subj: Policy Change Regarding the R lew and Approval of Stormwater Management Plans Associated with 401 Certification Applications The purpose of this memorandum is to initiate and publicize a major change in the review and approval of Stormwater Management Plans (SMPs) submitted as part of the 401 Certification application process. At present, all activities that require a 401 Certification and that will also have impervious surface coverage equal to or greater than 30%* (this 30% is referred to as the "impervious surface threshold") are required to submit a stormwater management plan as part of the 401 application process for review and approval by appropriate DWQ 401 Staff. This current DWQ review and approval is in addition to any local government review and approval of the SMP that may be required under local government implementation of aState-mandated stormwater program. In an effort to maximize the use of limited staff resources at the State and local level, and in order to streamline the permitting process alyd remove any unnecessary duplication in the review of these stormwater management plans, effective on the date of this memorandum, SMPs that have been approved by an element of a local government as part of that local government's implementation of aState-mandated stonnwater control program, will not require additional stormwater approval from DWQ 401 Staff for the approval and issuance of the 401 Certification, For the purposes of this policy, local approval of the SMP under the following State stormwater programs shall satisfy this requirement and shall not require the approval of the SMP by DWQ 40l permitting staff as part of the 401 application process: • Water Supply Watershed II, III, and IV • Local Implementation of fire NPDES Phase 2 Program • Universal Stormwater Management Program • Nutrient Sensitive Waters (NSW) Stormwater Nutrient Loading Limits • Randleman Lake Water Supply Watershed Stormwater Requirements Under this new policy, applicants shall submit: 1. A valid approval letter from the appropriate local government indicating that the proposed activity has a SMP that has been approved and indicating under which State stormwater program the approval has been granted along with a copy of the approved SMP, or 2. If the necessary local approval of the SMP has not yet been obtained at the time of application, the application should indicate that a SMP has been, or will be, submitted for local government approval, indicate the local government that approval is being requested from, and indicate under what State stormwater program the activity will be covered by_ Any 401 Certification approved under this st~arario shall be conditioned so that the proposed activity shall not commence until such time that the appropriate local approval has been granted. Applications for 401 Certifications for proposed activities that exceed the impervious surface threshold but are not within a local jurisdiction that is implementing a State stormwater program must still contain a SMP for DWQ review and approval. Applications that exceed the impervious surface threshold and do not contain a SMP or the information specified in #1 and #2 above, shall be returned as incomplete. As a result of this policy change, the Division of Water Quality will develop a comprehensive training program for those local government personnel directly involved in the SMP review and approval process. Once this training program leas been developed, the Division will require that local SMP review personnel attend and successfully complete this course of instruction in o~~der to continue the implementation of this policy within that local jurisdiction. The Division will also develop a proactive audit and review program that will be intended to ensure that the applicable stormwater program requirements are being successfully implemented at the local level. Notwithstanding the policy previously set forth within this document, the Director of the Division of Water Quality reserves the right to require the review and approval of individual stormwater management plans on a case-by-case basis in order to ensure that a proposed activity will not violate water quality standards. Additionally, the DWQ Director reserves the prerogative to provide comments to local governments of special provisions that may need to be incorporated into locally-reviewed SMPs in order to provide an enhanced level of protection to sensitive watersheds or to provide au enhanced level of stormwater control on unusual projects. The DWQ has determined that your application will require additional information. Please provide the following information so that we may continue to review your project and prevent denial of your application as required by 15A NCAC 2H .0506: 1. The submitted application is for a residential subdivision, NW29 (GC 3705). You have currently submitted a partial application (only including the road structures). Large subdivision projects can be phased, geographically by quadrants, but not as you have submitted. It is recommended that an office meeting be conducted after January 1, 2008 (preferably on January 2"d) in order to clarify the numerous items detailed below. The express clock will stop for the holidays at Spm of December 21, 2007 and restart again on January 2, 2007. 2. Please follow the guidelines in the PCN addendum. a. As per the guidelines, site "plans must show all built-out structures and impervious cover. The plans must include the final grading contours with elevations. The plans must indicate all utilities and easements". b. Additionally, platted parcels must be developable without further impacts to jurisdictional and non- jurisdictional wetlands, streams, water features, and- State regulated buffers. These parcels must be shown in order to determine that no further impacts will occur. c. Please clearly depict all of the wetland boundaries on the property. d. Please provide maps (at least 1:100) in sufficient detail to observe all parcels and features. 3. Diffuse Flow Provisions: a. Every proposed BMP structure for stormwater management or diffuse flow provisions shall be permanent, and not temporary. If a temporary BMP is needed for phase I and will be removed during future phases of development, please understand that a new (and appropriate) BMP must be approved by the DWQ and be installed before any existing BMP is removed. b. All buffer widths shall be measured from top of bank on both sides of all streams. Please show the top of bank along all streams on plans along with both Zones (1 & 2) of riparian buffer. c. Please site and design level spreaders in accordance with the current North Carolina Storrrtwater Best Management Practices Design Manual available at httR:://h2o.enr.state.ne.us/su/bmp forlrts.htm.
