MITIGATION PLANS
Dear Mr. Bailey:
Restoration Systems (Sponsor) is pleased to submit the accompanying draft Umbrella Mitigation
Banking Instrument (LIMBI) and its associated Phase I Bank Site Mitigation Plans (Mitigation
Plans) for our proposed Cape Fear 02 Umbrella Mitigation Bank (Bank; 2014 -SAW -00657). As
you will notice, the UMBI was drafted using the Wilmington District's (District's) most recent
template with participation and input from District staff, including yourself.
Regarding the Mitigation Plans, please notice that, as agreed, we have separated into four
separate documents: Benton Branch, Motes Creek, Orphan Creek and Rocky Top. In addition,
please note that in each Mitigation Plan (Appendix B) we have included site-specific
conservation easements and, where appropriate, easement assignments. These easement
documents will also be submitted separately and electronically for USACE counsel review.
With respect to draft financial assurances, within each Mitigation Plan you will notice the draft
language is written to provide the Sponsor with flexibility regarding the type of assurance used
performance bonds or casualty insurance policies. Site-specific draft performance bonds are
provided in each Mitigation Plan (Appendix F); however, draft casualty insurance policies were
not yet available for inclusion at the time of submission. The Sponsor will forward to the
USACE once available and will include with the submission of the next version of the LIMBI.
