PROJECT SETTING
Quible and Associates, P.C. has submitted a CAMA Major Modification request for
Phillip Carawan to modify an existing commercial fishing manmade basin (formerly Woodards
Marina) on the Albemarle Sound. The 356 acre project site is located at the end of Woodard Road
off of Deweys Pier Road (SR 1218) east of the Town of Columbia, in Tyrrell County. There is an
existing active Major CAMA permit (38-96) that permitted a 25ft wide by 225ft long by -6ft below
Normal Water Level (NWL) access channel into a 23 ft wide by 150ft long by -6ft below NWL canal.
This permit was modified in 1997 for two 150ft wooden jetties (with a height not to exceed 6inches
above NWL) to stabilize and protect the access channel. These jetties have not been constructed at
this time. These jetties were permitted as a compromise between the former owner of the property
and the resource agencies after longer rip rap jetties had been proposed. The property was sold to a
new owner that modified the permit in February 2015 to include two rip rap jetties (175ft and 183ft
long averaging 20 feet base width), rip rap 628ft by l Oft of the shoreline, bulkhead 3 00f of the canal
and expand the entrance canal to 60ft by 250ft by -6.5ft below NWL and the channel to 60ft by 300ft
by -6.5ft below NWL. At this time the structures permitted in February 2015 have not been
constructed. Currently the site includes 27 boat slips, a fish house, gravel parking and driveways, and
a boat ramp. A 47ft by 76ft roofed concrete pad adjacent to the fish house has been permitted but not
built at this time. Fishermen store their crab pots and other commercial fishing gear onsite: The site
is surrounded by agriculture to the south and forested wetlands and agriculture to the west and east.
Due to regular shoaling there has been routine maintenance excavation at the mouth of the channel in
4 of the last 6 years (2016, 2014, 2013, and 2010). These requests have been made to perform
excavation during the Anadromous Fish Spawning Area moratorium to allow safer navigation during
the crab fishing season.
The Albemarle Sound at the project site is classified as SB by the Environmental
Commission and as Coastal by the Marine Fisheries Commission. The Albemarle Sound is
approximately 7.5 miles wide at this location.
PROJECTDESCRIPTION
The applicant is requesting to construct a 265ft by 20ft access road through 404
wetlands (5,321ft2) for construction of the permitted jetties and maintenance excavation of the
channel. The applicant is proposing mitigation through on-site wetland conservation (5:1).
ANTICIPATED IMPACTS
The wetland fill will convert 5,321ft2 of vegetated wetlands to uplands.

Modification Request ('his is to accompany the overall Project Narrative that describes
economic need and background)
Prior to construction of the items permitted in CAMA Major 20-15 on 2/10/2015, Philip Carawan
would like to modify the existing permit. Based on our last interagency scoping meeting that
was primarily intended to discuss a proposed jetty widening and alternate construction methods,
including a pile -supported timber "crib system" with rock. It is currently the intention of Mr.
Carawan to build the jetties as currently permitted (without modifications), but he would like to
reserve the ability to discuss jetty widening in the future.
Proposed modification work includes:
Section 404 Wetland fill (5,321 sq.ft.) to access the western jetty. This proposed fill would
allow access to the jetty for construction and maintenance. Without this area of impacts, land-
based access to the jetty would have to include matting through a Section 404 area. This area
would include sand fill with a gravel or shell surface.
It is understood that USACE and DWR will require compensatory mitigation for this proposed
activity to offset fill impacts proposed. Please see the attached June 15, 2015 memorandum
related to the mitigation plan along with the mitigation bank acceptance letter.

Economic Benefits and Need for Improvements
Tyrrell County, along with other northeastern North Carolina counties, is considered a Tier 1
(distressed) County by NC Department of Commerce. In recent times, both agriculture and
manufacturing have declined sharply, and traditional manufacturing is virtually non -existent, -
Tyrrell County is currently the least populated county the state and has suffered from a
population decrease of approximately 7% since 2010. Philip Carawan, owner of Captain Neill's
Seafood, one of the largest employers in the County, is involved in the seafood industry,
including processing, sales and commercial fishing. The Albemarle Region of eastern NC has
historically been recognized as a top seafood producer. With many coastal fish houses and
marinas in coastal NC having been shut down, in large part from change of use of the coastal
waterfront, it is important to identify and preserve key existing facilities. Mr. Carawan purchased
the subject property in 2013 for its' existing boat basin and commercial fishing port capabilities.
The nearest Albemarle Sound commercial fishing ports are Alligator River Marina (-15 miles
from Carawan's Marina) and Mackey's Marina (-24 miles from Carawan's Marina).
Captain Neill's Seafood is an extremely important part of the local economy which currently
employs approximately 150 people in the seafood processing operation and is directly
associated with approximately 45 fishing boats (private operations with 2 people per boat). In
addition to the approximately 240 person direct salary positive impacts associated with the
operation, there are extensive secondary positive impacts to the economy. The operation
affects nearly every business in Tyrell County, including utility companies, grocery stores, J.uel -
stations, etc. Most of this cannot be accurately quantified, but as an example, the moi ;`��t
water bill for the company is commonly over $10,000.

Background
The subject property 'is an approximately 356 acre tract of land in Tyrrell County, on Ne'
Albemarle Sound, to the north of the Town of Columbia. The property is accessible from
Deweys Pier Road which leads to Woodard Road.
The property contains a man-made basin boat basin that is connected to The Albemarle Sound.
CAMA Major Permit 38-96 was originally issued in 1996 for the excavation of an upland basin in
high ground, maintenance excavation of an access channel in the Sound (to -6 ft NWQ,
dockage structures and a boat ramp. The permit was modified in 1997 to include construction
of a bulkhead around the perimeter of the boat basin, construction of a bulkhead in each side of
the entrance canals and construction of (2) 150 ft wooden groins into the Albemarle Sound.
This work is permitted, but not yet built at this time.
In 2011, a wetland delineation was performed and confirmed by USACE on the northern
(waterward) 120 acres of the subject tract. The upland areas of the property consist of
agricultural fields and some wooded uplands. The wetland areas are priarily_woom

Existing Environmental Conditions
The shallow water sound bottom consists of loose sand overlying clay beds in some areas. A
water depth survey and SAV analysis was performed in summer 2014 adjacent to the property
and also in the existing basin. No rooted SAV was observed in this area during this early June
survey. Based on conversations with representatives of NCDENR, this southern shore of the
Albemarle has not been known this to be an SAV area, likely from the high wave energy,
especially from NE wind events.
Shoaling has been a constant problem for maintaining an operable marina is this location.
Since original permit issuance, the marina can only operate by maintenance dredging every
year. And, the existence of the dredging moratorium in this area (beginning February 15'h of
each year) is problematic for marina operation due to the rapid shoaling that occurs after
February 15th and before the start of crabbing season. In fact, in many years', the entrance to
the basin shoals in almost immediately after an expensive dredge operation. Sand movement
occurs in this area from the shoreline to water depths exceeding 8 ft or more. This is evident
from aerial photograph inspection where bars and shoal formation and migration can be
followed.

Proposed Work
1. Channel Widening: The purpose of the proposed dredging is to maintain adequate a'icr
depths along the entrance to and within the existing man-made canal/basin and channel
connected to The Albemarle Sound so that there is safe ingress and egress for large scale
commercial fishing boast that draw 4.5 feet of water. The existing channel is permitted at 25
ft wide and -6 ft deep. This permit request is to widen the channel to 60 ft at -6.5 ft deep
(relative to NWL). In order for this commercial marina to be successful, it is extremely
important to maintain a safe navigable channel of at least -6.5 ft relative to normal water
level (NWL), since many boats that will draw at least 4.5 ft of water. Based on frequent low
wind tide events and/or rough seas that affect wave trough effective depths by 2 ft on
regular occasion, a baseline of -6.5 in the channel is absolutely necessary since these
fishermen need to work every day.
The excavation work will be performed with the use of a barge mounted and/or land based
(jetty based) long reach excavator using a clamshell bucket. The excavator will dig material
from the channel area onto a material (hopper) barge with sides. Use of a clamshell bucket
minimizes the amount of bottom disturbance, and when the bucket is fully loaded, the
amount of water transferred to the barge is minimal. The barge, when loaded, will be moved
inside the basin and the material will be transferred to soil stockpile areas in the adjacent
agriculture fields on the subject property. If excavation is from land (jetty and/or beach) and
mats instead of barge, the full bucket of material will be directly transferred to a dump truck
and then it will be transferred to the same stockpile/disposal areas.

2. Channel Protection Jetties: Permitting of rock and concrete channel protection jetties was
the main topic of a July 9, 2014 interagency scoping meeting. The jetties proposed would_
be on either side of the 60 ft wide channel and would extend 250 ft and 257 ft respectively in
to the sound, following the same angle as the existing permitted channel. These jetties
would be approximately 100 ft longer than the permitted (but not built) wooden groins (they
are permitted to 150 ft).

Constant shoaling and longshore sand movement is the primary need for these jetties.
While the fastest sand movement is in.shallow water, sand movement clearly does occur out
to the naturally occurring project depth (-6.5 ft) and greater. Without channel protection
jetties, the channel quickly shoals in and requires maintenance dredging.
Rock and concrete is a much more permanent solution to the channel protection problem
than vertical sheet.pining groins or jetties. This is an extremely high energy shoreline that
can quickly destroy sheetpile structures, both from wave energy and also from the battering
effect of trees, pilings and other items that ram into and tear out structures. This is a
commercial facility and needs to be armored as such. Mr. Carawan's idea is to adequately
armor this facility the first time. This will allow the livelihood of Captain Neill's Seafood and
and fishermen to proceed uninterruptedly. As we all have seen, North Carolina's

help manage the system. What we need to ensure for the commercial fishetmen is a way to

During the scoping meeting, the jetty footprint discussed was up to 36 ft widel. We,�iv-�h,
since been able to reduce the proposed jetty footprint to an average width of 20 ft. This was
done as an attempt to avoid and minimize the bottom footprint of the rock structure.
Included on the CAMA Major Plan is a cross-section of the channel with jetties. Initially
(going in to the scoping meeting), the jetty would have been built at a 2:1 slope adjacent to
the edge of the channel. We have now separated the edge of the jetty from the channel
edge by at least 10 ft, allowing a reduction in the width. The width has been further reduced
by building the structures at a 2:1 slope from the substrate up to NWL. Instead of continuing
to build the wall up another 3 ft with a plateau on the top (for machine access down the
.structure), the actual future work plateau will be at or near NWL. There will be a pile of rip -
rap on top of the plateau (up to 3 ft above NWL), but, this material will be removed for
machine access when maintenance to the jetty of channel is needed. When the
maintenance work is complete, the material will be put back in place.
For local comparison purposes, the jetty system at the Alligator River Marina appears to
extend about 300 ft into the river and is reportedly much wider than what we are proposing
herein.
Basin Entrance Widening: In order to widen the entrance to the boat basin to allow safe

wetlands and 1,443 sq.ft of uplands is proposed. The total volume of material to be
excavated in this area is 1,134 cu yds. The material will be dug from a land based
excavator, starting at the shoreline area closest to the Albemarle Sound and will work back
from there. When necessary, timber mats will be used in 404 areas to support the
excavator. Excavated material will be spread on upland agricultural areas, similarly to the
channel material.
Adjacent to wetlands, 300 lin.f t. of cantilevered bulkhead is proposed so that there would be
no bulkhead backfill in this area.
4. Shoreline Stabilization Rip -Rap: 628 of shoreline stabilization rip -rap (10 ft wide x 3 ft high)
is proposed to protect the natural shoreline from ongoing erosion at or near the existing
normal water line.
