The impacts are limited to 137 liner feet of permanent stream impacts as well as 25 linear feet of temporary impacts for the construction of a sanitary sewer line, based on a delineation submitted to your office by Soil & Environmental Consultants, PA. Buffer impacts associated with the road crossing total less than 150 linear feet and 1/3 of an acre. Project Purpose The purpose of the proposed project is to construct an apartment complex in an area with mixed residential development to provide multi -family housing opportunities for this economic sector. Impacts are necessary to access high ground and to maximize the economic return through net leasable space, as well as to comply with DOT requirements regarding ingress and egress to the site. Proiect Need The stream impact is necessary in order to access the high ground located centrally within the site, where the apartment complex is located. Further, the stream crossing is necessary in order to meet the standards regarding line of sight mandated by DOT in order to have dual multilane ingress and egress from both Okelly Chapel Road as well as NC Highway 55. The temporary construction impact associated the utility is necessary for the construction of a sanitary sewer to properly remove and treat wastewater, another condition of the Clean Water Act. Proiect Description The project consists of the proposed apartment complex, club house and amenities, retaining walls, appurtenant parking facilities, and construction of a multilane through -access road. Local approvals require the establishment of stream buffers and open space. Transportation approvals mandate the establishment of multilane ingress and egress for safety and they dictate that the driveways be located within a certain range of locations. WETLAND AND ENVIRONMENTAL CONSULTANTS An offsite utility line is also planned as a way to provide sanitary sewer to the residents of the apartment complex. A construction profile of this sewer line has been provided with this application. Oak mats will be placed along 25 linear feet of stream to allow the temporary crossing of machinery necessary for construction of the sewer. There will be no loss of waters associated with the temporary impacts as they will restored to pre -construction contours and elevations after construction and will be allowed to re -naturalize. The impact drawings include sufficient detailed site specific topographical data to reconstruct the pre -construction conditions. Avoidance and Minimization The central location of the apartment complex was carefully planned as to minimize impacts to regulated waters. The road crossing has been designed to utilize retaining walls, approximately 20 feet in height, in order to minimize the impact to the regulated stream. The construction of higher retaining walls becomes unpractical as the cost of building such walls becomes increasingly infeasible as the height is increased. Mitigation As the stream impacts associated with the project total less than 150 linear feet and there are no wetland impacts, mitigation for the loss of waters is not proposed. Buffer mitigation is also not proposed as the buffer impacts associated with the road crossing total less than 150 linear feet and 1/3 of an acre of riparian buffer. The project has been designed to avoid impacts to regulated features to the greatest extent practicable. The only permanent impact is necessary for through -access per DOT requirements as well as to access high ground. The road crossing will utilize retaining walls, approximately 20 feet in height, in order to minimize the impact to the stream as much as possible. Higher retaining walls are not feasible as they become very cost -prohibitive. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. The site will be constructed under an approved Erosion Control Plan. An aerial sewer crossing will be utilized in order to minimize impacts, with the only temporary impact in the form of oak mats necessary for installation and the crossing of machinery. Following completion of temporary utility impacts, all slopes will be restored to original contours and re -seeded and allowed to naturalize. 2.
