n Dear Ms. Burdette and Mr. Dorney:
On behalf of Stone Hedge Carolinas (property owner), we hereby request authorization
from the US Army Corps of Engineers (USACE) to use Nationwide Permit 39 for
proposed permanent impacts to a stream channel and jurisdictional wetlands resulting
from the construction of a residential community. In addition, we request written
concurrence from the North Carolina Division of Water Quality that the project complies
with the Neuse Buffer Rules and the General Certification #3402. A Pre -construction
Notification Application (PCN) is attached, which includes an agent authorization form.

The + 80 -acre subject property is located on the east side of NC Highway 55
approximately a half -mile north of its intersection with Sunset Lake Road. Please refer
j to the attached portion of the USGS map (Figure 1) for the project's location on the
j Apex, NC topographic quadrangle.

S&EC completed a detailed wetland delineation and Neuse River Buffer evaluation on
the property on November 25, 2002. Ms Andrea Wade of the USACE issued a
notification of jurisdictional determination on June 2, 2003 (AID 200320638). Ms.
0 Deborah Edwards of the NC-DWQ made a site visit and confirmed the buffers on
November 20, 2002 (NRRRO 03-035). Mr. Dave Penrose of the NC-DWQ also visited
the site to make a perennial stream determination on February 10, 2003. Mr. Penrose
determined that the stream becomes perennial at point approximately 15 feet downstream
of the point in which it becomes buffered.

The subdivision's proposed impacts consist of 245 linear feet of perennial channel, 15
feet of intermittent channel, and 0.017 acres of wetland impact resulting from the
proposed construction of the residential subdivision. Impacts are due primarily to the
main thoroughfare road, Straywhite Avenue, which is on the Town of Apex's
thoroughfare plan. A small wetland area (n fl acre) and intermittent stream channel (15
LF) will be imna-+-a'-- )ond located at the top of the drainage.
