Guilford County
On December 4, 2007, the Division of Water Quality (DWQ) 401 Oversight/Express Permitting Unit
received your application dated December 7, 2007, with additional information received by DWQ on
January 3, 2008 regarding your request for a Major Variance from the Randleman Buffer Rules (15A
NCAC 2B .0250) for the subject property. The Division of Water Quality (DWQ) is required to prepare a
"preliminary finding" /"finding of fact" as to whether the variance request meets the requirements of 15A
NCAC 02B .0104(r). The DWQ may attach conditions to a variance approval that support the purpose,
spirit and intent of the riparian buffer protection program. Conditions usually include stormwater
management and buffer mitigation.
Additional information will be required before we can proceed with the review of your variance request.
Therefore, unless additional information is provided as described below, we will have to move toward
denial of your request per 15A NCAC 2B .0250 and 1 SA NCAC 02B .0104(r) and will place this project
on hold as incomplete until we receive this additional information.
Additional Information Requested:
1. Buffer/Stream Restoration
Please submit a detailed restoration plan for the proposed restoration of the perennial stream at
the site.
2. Stormwater Management
Please revise your plan sheets to show the temporary sediment basins on the site. Also include
worksheets for your temporary sediment basins and retention pond. Inspection and Maintenance
(I&M) forms will be required for these structures as well. The forms can be downloaded from the
following website: http•//h2o enr state.nc.us/su/bmp forms.htm
3. Sheet Flow/Diffuse Flow
Please indicate the diffuse flow provision measures on the site plan. Be sure to include the
applicable worksheets and I&M agreements for the diffuse flow/sheet flow measures.

Restoration Plan
Please provide information and data on the current site conditions, and the need for restoration of
the perennial stream. Plans showing current stream conditions and geomorphic measurements
describing pattern, profile and dimension demonstrating the need for restoration of this stream, as
well as geomorphic data on the proposed restoration (pattern, profile and dimension data for
restored reach) should be included.
5. Please show all wetlands and proposed wetland impacts on your plan sheet.
Please respond in writing within three weeks of the date of this letter by sending a copy of this
information to me and to Sue Homewood of the DWQ Winston Salem Regional Office. If we do not hear
from you in writing within three weeks, we will assume that you no longer want to pursue your variance
request and we will consider the request as withdrawn. Please call 1 of this office at
