Dear Mr. Shaver and Mr. Herndon,
On behalf of the North Carolina Department of Transportation (NCDOT) Division 3
environmental officer, Mr. Stonewall Mathis, this submittal serves as a preliminary
jurisdictional determination (PJD) request as well as a pre-construction notification
(PCN) application requesting written concurrence from the US Army Corps of
Engineers (USACE) and the NC Division of Water Resources (NCDWR) that the
activities proposed below may proceed under Nationwide Permit 3 and General Water
Quality Certification (GC) 3883.
Project Purpose and Need
The Ash Little Road SW (Regan Branch) Pipe Replacement project (Project) proposes
to replace one 60" Corrugated Metal Pipe (CMP) at 50' on 93 degree skew with one
78" CMP at 47' on 93 degree skew with a 22.5' inlet headwall diving down and a 31.5'
outlet headwall diving down for an overall structure length of 47.5'. The existing CMP
is undersized and has deteriorated presenting a safety concern. The proposed
replacement will provide adequate flow to prevent damming and address the existing
safety concerns, while also allowing for aquatic life passage.
Project Location
Ash Little Road SW (Regan Branch) SR 1300 is located southeast of Longwood in
Brunswick County, NC (Figure 1). The project area consists of approximately 0.77
acres and lies 0.8 miles north of NC 904 and 0.2 miles south of the junction with
Spring Branch Road (SR 1322) (Figure 2).
]urisdictional Features
A delineation of jurisdictional features conducted by SEPI on )anuary 7, 2016
identified one jurisdictional stream (Stream SA) and one jurisdictional wetland area
(Wetland WA), as shown on Figure 4. Perennial stream SA is shown as a solid blue
line on the USGS topographic quadrangle (Figure 5). LiDAR imagery of the site is
shown in Figure 6. Photos 1-6 of the jurisdictional features are also included.

Proposed Impacts
There are a total of 59 linear feet (LF) of proposed permanent stream impacts for the
outlet and inlet headwalls and class B rip rap (Impact Figures attached). The
proposed rip rap placement in the existing stream channel is intended to stabilize the
headwall and fill a large blow hole on the outlet side. A total of 20 LF of temporary
stream impacts are proposed for de-watering. There are no proposed wetland
impacts associated with this project. The pipe will be buried at least 1 foot below the
natural stream bed elevation as determined from upstream and downstream
elevations. A filter fabric waiver is requested for this site.

To preserve the safety and mobility of the travelling public by replacing the existing deteriorated pipe structure.

NCDOT plans to replace one 60" Corrugated Metal Pipe (CMP) at 50' on 93 degree skew with one 78" CMP at 47' on 93
degree skew with a 22.5' inlet headwall diving down and a 31.5' outlet headwall diving down for an overall structure
length of 47.5'. Standard road construction and pipe replacement equipment such as cranes, excavators, dump trucks,
and similar vehicles would be used for the project. Proper erosion and sedimentation control measures would be
employed throughout the project. Once the pipe is replaced, the roadway area disturbance would be repaved.

1. The Corps af Engineers belie�es that there may be jurisdictionai waters of the
United States an the subject site, and the permit applicant ar other affected party
who requested this preliminary J�D is her+�by advised of #�is or her option to
request and obtain an appro�ed jurisdictional d�term�nation �JD} for that sit�.
Nevertheless, the permit �pplican� or other persan who requested this
preliminary J❑ has dec�ined to exercise the option to obtain an approved JD in
this instance and at this time.
2. In any circumstance where a permii applicant obtains an individua! permit, or
a Nationwide General Permit (NWP) or other general permit verification requiring
"`pre-cons#ruction noti�cation" (PCN), or requests verification fvr a nan-reporting
fVWP or other general permit, and the permit applican# has not requested an
approved JD for the activity, the permit applicant is hereby made aware of the
faUowing: (1) the permit applicant has el�cted to seek a permit authorization
based on a preliminary JD, which does nat make an afficial determination of
jurisdictional waters; {2} that the appiicant has the option to reques# an approved
JD beiare accepting the terms and �conditivns of the permit authorization, and
that basing a permit autharizat�on on an appro�ed JD could possibly result in less
compensatory mitigafron being required or different special conditions; (3) that
the applicant has the right to request an individual permit rat�er than accepting
the terms and con�itivns of the NWP or other general permit authorization; (4)
that the applicant can accept a pem�rii authorizatian and thereby agree to cvmply
with all the terms and canditions af that permit, including whatever mitigation

NCDOT Pipe Replacement on SR 1300 (Ash-Little River Road - Regan
Branch), Brunswick County, NC.
An evaluation of natural communities and threatened and endangered (T&E)
species for the NCDOT Pipe Replacement on SR 1300 (Ash-Little River Road -
Regan Branch) 1.8 miles north of NC 904, south of Ash in Brunswick County
included a GIS-based review of aerial imagery, USDA soil survey mapping, USGS
topographic mapping and LiDAR imagery; a wetland and stream delineation; review
of the North Carolina Natural Heritage Program (NCNHP) web-based mapping tool;
and a field survey by qualified environmental scientists.
Fifteen federally threatened and endangered species are listed in Brunswick County
by the US Fish & Wildlife Service (USFWS), including American alligator (T), Bald
Eagle (BGPA), Green sea turtle (T), Hawksbill sea turtle (E), Kemp's ridley sea
turtle (E), Leatherback sea turtle (E), Loggerhead sea turtle (T), Piping plover (T),
Red-cockaded wood pecker (E), Red knot (T), West Indian manatee (E), Wood
stork (T), Cooley's meadowrue (E), Rough-leaved loosestrife (E) and Seabeach
amaranth (T).
Biological Conclusion:
No Effect
Review of GIS data and the NCNHP web-based mapping tool indicated habitat for
American alligator within and surrounding the project area. The project crosses
Regan Branch which is a tributary to the Waccamaw River which could support the
American alligator. A field survey of the project area was conducted on January 7,
2016 and no federally listed species were observed.

Roject Description: The project [SR1300 (Ash-Little River Road)] is located south of Ash in Bmnswick
Co�nty, North Carolina. The project aroe consists of approximatety 0.42 acres and lies 0.2 miles south of
SRt322 (Spring Branch Rd NW). Replacement of one 60" CMP with one 78" CMP with a headwall is
proposed. The archaeological APE is centered upon the pipe location end measures 300ft in length and
60ftin width.
SUMMARY OF CULTORAL RESOURCES REVIEW

Permitting and funding information was reviewed for determining the level of archaeological input required 6y
state and federal laws. Based on the submitted "request for cWtural resources review" form, the project is entirely
state-funded with federal permit interaction. As such, Section 106 af the National Historic Preservation Ac[ will
apply and the United States Army Corp of Engineer will serve as the lead federel agency. Next, construction design
and other data was examined (when applicable) to define the character and ex[ent of potential impacts to the
ground surtaces embracing the project locale. 7here will be no widening, movement of ditches, or any other work
outside the existing, 60k wide disturbed right-of-way. Once an APE was outlined, a map review and site file search
was conduc[ed at the Office of StateArchaeology (OSA) on Tuesday, January 12, 2015. No previously documented
archaeological sites are located In the APE limits or directly prozimal.
An inspection of Natlonal Register of Historic Places (NRHP), State Study Lirted (SL), Locally Designated (LD�,
Determined Eligible (DE), and Surveyed Site (55) properties employing the NCSHPO website evidenced an ahsence
of these historic resources within the immediate prqect area. In addition, historic maps of erunswick County were
appraised to fur[her identify former structure locations, land use pattems, or other mnfirma[ion of histodc
occupation in the prqect vicinity. Archaeologiwl/historical reference materials were inspected as well. In general,
the cultural background review established that no NRHP listed properties, previously remrded archaeologiwl
sites, or cemeteries are located within the APE. eased on cultural-historical tactors, theAPE is considered to have a
law potential for the documentation ot archaeologiwl resources.
Further, topographic, geologic, Flood boundary, lidar and NRCS sail survey maps (Mk, BaB) were referenced to
evaluate pedeological, geamorphological, hydrological, and other environmental determinants that may have
resulted in past occupation at this lowtion. Aerial and on-ground photographs (NC�OT Spatial Data Viewer) and
the Google Street View map application (when amenable) were also ezamined/utilized for additional assessment
of disturban<es, both natural and human induced, which compromise the integrity of archaeological sites.

Review of HPO quad maps, HPO GIS informafion, historic designations roster, and indexes was
undertaken on January 8, 2016. Based on this review, there aze no existing NR, SL, LD, DE, or
SS properties in the Area of PotenGal Effects, which is approximately 150' from the cen[er of the
creek north to south and 30' from the centerline each way. According to Brunswick Counry
GIS/Ta�c Information, all properties within the APE aze under fifty years of age. There aze no
National Register listed or eligible properties, and no survey is required. If design plans change,
