Mrs. Spears,
Based on a review of the Minor Modification request for State Permit # 28-08 and DWR Project No. 2006-1761 V3 for
the construction of a two platforms cantilevered off the permitted pedestrian traversing the Section 404 Wetlands, this
Office has the following comments:
The impacts are to be limited to shading on waters with no impacts encroaching within the Neuse River Riparian
Buffer. Any impacts to the Neuse River Riparian Buffer would require the submittal of a Major Variance application due
to considered a "Prohibited" activity within the Table of Uses (15A NCAC 02B .0233(6)).
