Department of Environmental Quality 8 Findings of Fact –Section 9-9-11(c)(1)(a), (b), and (c) There are practical difficulties or unnecessary hardships that would prevent compliance with the Ordinance:  a)If the applicant complies with the Ordinance it would result in a 45 % reduction in capacity.  b)The physical nature of this site is the key constraint limiting landfill expansion alternatives and preventing reasonable use of the property.  c)The Site was developed as a C&D landfill facility by DH Griffin, and was transferred to WCA Waste Corporation prior to being acquired by the current applicant, Waste Industries (WI). Department of Environmental Quality 9 Findings of Fact –Section 9-9-11(c)(1)(d) and (e)  d)The property contains an existing C&D landfill, which is in itself relatively rare.  e)Expansion to the east is the only alternative available to make use of the remaining property. Department of Environmental Quality 10 Findings of Fact –Section 9-9-11(c)(2) The variance is in harmony with the general purpose and intent of the Ordinance and preserves its spirit:  The proposed project would have minimal effect on water quality, the protection of which is the primary purpose and intent of the Ordinance. Waste Industries is proposing to provide compensatory mitigation for the current resources on site, which would provide water quality benefits in the local area. Compensatory mitigation would be in the form of in-lieu fee payment. Department of Environmental Quality 11 Findings of Fact –Section 9-9-11(c)(3) The granting of the variance assures the public safety and welfare and does substantial justice:  The proposed facility design and operation, as well as the history of the existing facility, provide ample evidence that public safety and welfare have been considered and ensured for the future. Department of Environmental Quality 12 City of High Point Recommendation The City’s Watershed Review Committee recommendation is that the Water Quality Committee approve this major variance request with buffer impacts as amended in the addendum to the Variance Application submitted to the Division. •If the Water Quality Committee approves this request, the City recommends approval with the following conditions or stipulations: •Mitigation •The applicant shall provide mitigation for the proposed impacts by purchasing a total of 94,619 square feet of buffer credits from the NC Division of Mitigation Services as indicated in their application. •A final Site Plan (including the Watershed Control Plan component) is approved by the Technical Review Committee (TRC) prior to disturbance within the buffer area. •This major variance shall only apply if the NCDEQ and USACE approve impacts to the streams associated with the subject buffers.
