Dear Mr. Pierce:
On November 2, 2007, the Division of Water Quality (DWQ) received your application dated September
28, 2007, to fill or otherwise impact 1.396 acres of 404/wetland (0.835 acres permanent impact and 0.561
acres temporary impact) and 6061inear feet of stream impact (446 linear feet permanent impact and 160
linear feet temporary impact) to construct the proposed residential subdivision. On November 19, 2007,
November 29, 2007, January 9, 2008, and February 5, 2008, the DWQ received additional information
from you, however, the DWQ has determined that your application remains incomplete and/or provided
inaccurate information as discussed below.
There are numerous lots that will need additional wetland fill in order to construct homes,
specifically, lots 225, 226, 227, 332, 335, the unnumbered lot near crossing No. 9, 391, and lots
east of "insert 1" along the cul-de-sac. Please provide a detailed site plan at a scale of no smaller
than 1 "=50' of the entire development so we can determine if only additional wetland impact will
be needed to construct the subdivision. Also, please provide written justification why these
impacts are needed for this development.
2. As noted in our December 11, 2007, letter, DWQ will also need the location, plans, and profiles
for the stormwater devices. This includes the following: please provide a BMP Supplement Sheet
for each proposed best management practice that will be used on the site (including both
worksheets, Design Summary and Required Items Checklist), as well as all of the required items.
The BMP Supplement Forms are available on the DWQ web site at:
http://h2o.enr.state.nc.us/su/bmp_forms htm. This information was not provided in your January
9, 2008, response. Please provide them in your renewed application.
For these reasons your permit application is hereby considered returned. Once you have redesigned your
project to address the problems and inadequacies with your application as it was submitted, you will need
to reapply for DWQ approval. This includes submitting a complete application package with the
appropriate.
