Dear Mr. Kichefski:
The NC Department of Transportation is experiencing bank erosion adjacent to the
subject route. Very little shoulder remains at this location and the situation needs to be
corrected soon. We are proposing to install 60 linear feet of a Polypropylene Retention
System (PRS) along the streambank of Elk Creek (Class: C; Trout: +). This will allow us
to reestablish the shoulder to improve safety and will stop the ongoing erosion issue.
The proposed activity will require temporary dewatering. An impervious sandbag dike
will be constructed upstream of the work area. Clean water will be temporarily pumped
around the operation during construction. Any dirty water located inside of the
construction area will be pumped into a silt bag if necessary. Preconstruction streambed
elevations will be restored once the work is complete. Dewatering impacts at this
location will be about 40 linear feet.
We also have a rotten 18" wet pipe carrying a UT to Elk Creek that discharges in the
damaged area. This pipe will be replaced during construction of the retaining structure.
We will alter the skew of the wet pipe so it will discharge just upstream of the new PRS.
The new pipe will be shorter as a result but we will need about 20 linear feet of
dewatering on the inlet side during installation. Bedrock is present at this discharge point
so we may be able to improve the existing perched condition but we will not bury this
pipe into the streambed.
This project was reviewed for the presence of threatened and endangered species in May,
2016. This project is very limited in scope and will have no effect on any federally listed
endangered plant or animal species. No trees will be cut, just one bush. This activity is
exempt from cultural review but no known cultural resources are adjacent to the repair
area anyway.

The project impacts are not significant in nature and should improve water quality by
eliminating the ongoing erosion issue. Downstream water quality standards will be
protected by utilizing appropriate BMPs during construction.
Attached is a Preconstruction Notification Form, site sketch, a marked county map, a
marked topography map and photographs.
By copy of this electronic letter, it is requested that Mrs. Marla Chambers with the North
Carolina Wildlife Resources Commission comment directly to you concerning the 404
Nationwide Permit application with a copy sent to me.
We would like to begin construction as soon as possible. If further information is
required, please let me know. Your early review and consideration will be appreciated.
