This letter is to answer comments received March 31, 2016 in regards to the PCN submitted
March 3, 2016 on behalf of Kent Wiles for the Damascus Church Road project. I have copied
your comments below and my responses are in blue.
Provide the project location on the most recent published county soil survey and delineate
the site boundary on the soil survey.
A map has been created to show the most recent soils data released by the Web Soil
Survey website. See Project Area Soils Map in Attachment 1. Please note that the map
also shows an updated wetland boundary. Previous maps show the wetland area as the
floodplain width along the access road. However, the actual wetland is a small area inside
the floodplain. The wetland impacts have not changed.
2. The invoice that was submitted for riparian wetlands mitigation has expired and no
receipt for payment for the mitigation was included with the application. A current
invoice or proof of payment for this mitigation must be provided.
A current EEP invoice is located in Attachment 2.
Please be aware that Orange County currently has delegated authority for riparian buffer
determinations, authorization of impacts, and reviews for diffuse flow. This program is
administered through Erosion Control/Stormwater within the Planning and Inspections
Department.
I had a conversation with Steve Kaltenbach from Orange County Erosion
Control/Stormwater about this comment. He has requested a copy of the PCN so that he
can review the project. His contact number is 919-245-2588.

The North Carolina Ecosystem Enhancement Program (NCEEP) has received a check as indicated above as payment for the
compensatory mitigation requirements of the 401 Water Quality Certification/Section 404/CAMA Permits) issued for the
above referenced project. This receipt serves as notification that your compensatory mitigation requirements associated with
the authorized activity as specified below have been satisfied. You must also comply with all other conditions of this
certification and any other state, federal or local government permits or authorization associated with this activity.
The NCEEP, by acceptance of this payment, acknowledges that the NCEEP is responsible for the compensatory mitigation
requirements associated with the project permit and agrees to provide the compensatory mitigation as specified in the permit
The mitigation will be performed in accordance with the Memorandum of Understanding between the NC Department of
Environment and Natural Resources and the US Army Corps of Engineers dated November 4, 1998, as indicated below.

Please note that a payment made to the Ecosystem Enhancement Program is not reimbursable unless a request for
reimbursement is received within 12 months of the date of the receipt. Any such request must also be accompanied by letters
from the permitting agencies stating that the permit and/or authorization have been rescinded. If you have any questions or
