The following are our responses. 1. Title 15A NCAC 02H .0506 requires that a proposed activity has no practical alternative by demonstrating that, considering the potential for a reduction in size, configuration or density of the proposed activity and all alternative designs, the basic project purpose cannot be practically accomplished in a manner which would avoid or result in less adverse impacts to wetlands. Because the preferred alternative involves the greatest amount of wetland impact, the Division cannot review this alternative until the U.S. Army Corps of Engineers (USAGE) determines that this alternative is the least environmentally damaging practical alternative (LEDPA). Please provide correspondence from the USACE indicating which alternative is selected as the LEDPA. Response: The alternatives analysis is still under review with the USACE and all correspondence will be provided by Angler Environmental as it is received. 2. Stream impact S3 — 5.48 linear feet is labeled as a temporary impact. This should be classified as a permanent impact since the stream will be relocated away from this small section of channel and it will no longer receive upstream flow. Response: Stream impact S4 - 5.48 linear feet has been re -labeled as permanent on the impact maps and PCN. 3. Stream impact S 1 — 462.2 linear feet is labeled as temporary. Since the channel will be filled, this should be classified as a permanent impact. Relocation of the stream will be considered as self -mitigating. Response: Stream impact S1— 462.2 linear feet has been re -labeled as permanent on the impact maps and PCN. 4. Grading and revegetation (fill) in Zone 2 of the buffer is an exempt activity that does not need to be quantified. The stormwater discharge into the buffer from the stormwater BMP is an allowable activity that requires the impact to be quantified for approval. These changes are reflected on both the impacts maps and PCN. 5. Explain how erosion in Zone 1 from the SW discharge will be prevented. These types of discharges are usually. connected to the stream channel unless the discharge is anticipated to be non-erosive. Response: The proposed stormwater management pond has been designed to detain the 1-, 10- and 25 -year flows to be less than the pre -developed conditions. Rip rap outlet protection at the end of the primary outfall (SWM culvert) and riprap protection on the emergency spillway have also been proposed to prevent stormwater discharge into Zone 1. 6. Add dashed outline of the existing road within the buffer to make the existing use clearly discernable on the buffer impact map. Response: A dashed outline of the existing road within the buffer has been added to the impact map. 7. This Office has the following comments regarding the stream restoration design. Green ash should be substituted for loblolly pine in the planning plan. b. Proposed log sills should be installed with footers and/or matting to prevent piping and eventual undermining. Response: Green ash has been substituted for loblolly pine in the planting plan and footer logs were added to the log grade control structures to prevent piping and eventual undermining. Based on the revisions displayed within the plan and/or the responses provided within this comment - response letter, we feel that we have adequately addressed or responded to your comments presented April 14, 2016.
