Dear Sir or Madam:
On January 28, 2008, the Division of Water Quality (DWQ) received your application dated November
20, 2007, to fill or otherwise impact 146 linear feet of perennial stream and 8,465 square feet of Zone 1
Neuse River basin protected riparian buffers and 4,484 square feet of Zone 2 Neuse River basin protected
riparian buffers to construct the proposed residential subdivision. The DWQ has determined that your
application was incomplete and/or provided inaccurate information as discussed below. The DWQ will
require additional information in order to process your application to impact protected wetlands and/or
streams on the subject property. Therefore, unless we receive five copies of the additional information
requested below, we will have to move toward denial of your application as required by 15A NCAC 2H
.0506 and will place this project on hold as incomplete until we receive this additional information.
Please provide the following information so that we may continue to review your project.
Additional Information Requested:
1. Please re-submit your site plans on full plan sheets at a scale of no smaller than 1 "=50'.
2. Please provide a BMP Supplement Sheet for each proposed best management practice that will be
used on the site (including both worksheets, Design Summary and Required Items Checklist), as
well as all of the required items. The BMP Supplement Forms are available on the DWQ web
site at: http://h2o.enr.state.nc.us/su/bm~ forms.htm.
3. Per the requirements of GC 3705, this project must comply with Stormwater Management Plan
(SMP) Requirements for Applicants Other Than the North Carolina Department of
Transportation, available at:

T.pdf. Please include an SMP that removes a minimum of 85 percent TSS anal 30 percent TN
from the stormwater generated by this project. For each proposed BMP, please provide a
completed BMP Supplement Form, with all the required items. The BMP Supplement Forms are

4. Per the requirements of the Neuse Riparian Buffer Rule, all stormwater drainage from this site
must be discharged through a correctly designed level spreader. Level spreader design
requirements are set forth in Chapter 8 of the North Carolina Stormwater BMP Manual, available
at: http://h2o.enr.state.nc.us/su/bm~ forms.htm
5. Please provide one Level Spreader Supplement Form for each proposed level spreader, available
at: http://h2o.enr.state.nc.us/su/bmp forms.htm. Please include the Required Items checklist and
all items listed therein.
6. Please locate all of the protected riparian buffers as overlays on the site plan, clearly showing
Zone 1 and Zone 2.
7. This Office believes that the road crossing labeled on the plans as RC-1 can be bridged to avoid
the impacts to the stream. Please revise the plans to avoid the impacts.
8. In Section V of the PCN you state that there are no future plans for the site. However, on plan
sheet C-3A, you show a future box culvert. Please revise your plans to show all proposed future
impacts.
Please submit this information within 30 calendar days of the date of this letter. If we do not receive this
requested information within 30 calendar days of the date of this letter, your project will be withdrawn
and you will need to reapply with a new application and a new fee.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not
