Sullins, Director Division of Water Quality February 4, 2008 DWQ Project # 2008-0197 Wake County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Jonathan Coulter 2713 N Mayview Road Raleigh, NC 27606 Subject Property: Gravel driveway at Lot 13 in the Cardinal Hills Subdivision in Raleigh, NC REQUEST FOR MORE INFORMATION Dear Mr. Coulter: On January 24, 2008, the Division of Water Quality (DWQ) 401 Oversight/Express Permitting Unit received your letter and attached plat regarding your request for a Minor Variance from the Neuse Buffer Rules (15A NCAC 2B .0233) for the subject property. Additional information will be required before we can proceed with the review of your variance request. Therefore, unless additional information is provided as described below, we will have to move toward denial of your request per 15A NCAC 2B .0233 and will place this project on hold as incomplete until we receive this additional information. Additional Information Requested: 1. Permit For the proposed gravel driveway, you must submit an application for a buffer authorization on a Preconstruction Notification Form since the driveway is an "allowable with mitigation" activity under the use "road impacts other than crossings of streams and other surface waters subject to this Rule" in the Neuse Buffer Rules (15A NCAC 02B.0233(6)). A PCN form is attached for your use. The DWQ will require three (3) copies of the completed form and associated attachments. 2. Buffer Mitigation Buffer mitigation is required, for the impervious surface of the proposed driveway that is in the protected riparian buffer. Please provide a buffer mitigation plan pursuant to 15A NCAC 02B .0242. If you choose to pay into a mitigation bank for the required mitigation, please provide an acceptance letter from the mitigation bank demonstrating they have the available mitigation credits. 3. Shed in Zone 1 If the shed shown on your plan sheet in Zone 1 of the protected riparian buffer was not built prior to the Neuse Buffer Rules (July 22, 1997), then a Major Variance is required for the shed. Diffuse Flow Please indicate the diffuse flow provision measures on the site plan. Please respond in writing within three weeks of the date of this letter by sending a copy of this information to me and to Lauren Witherspoon of the DWQ Raleigh Regional Office. If we do not hear from you in writing within three weeks, we will assume that you no longer want to pursue your variance request and we will consider the request as withdrawn.
