WQ0002284, dated January 31, 2003, to Outer Banks / Kinnakeet Associates, LLC for the construction and operation of the subject wastewater treatment reclaimed water utilization system. This permit shall be effective from the date of issuance until December 31, 2007, shall void Permit No. WQ0002284 issued August 7, 2002, and shall be subject to the conditions and limitations as specified therein. Please pay particular attention to the monitoring requirements in this permit. Failure to establish an adequate system for collecting and maintaining the required operational information will result in future compliance problems. Since this permit greatly differs from the one last issued December 13, 2001, please carefully read each permit condition. Please pay close attention to the following condition for they are particular to your permit: - Condition III.2 -This condition requires surface water monitoring three (3) times per year at two locations (DD-1 & DD-2). Please refer to attached Figure II for the exact location of the sampling points. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. Klimek, P.E. cc: Dare County Health Department Washington Regional Office, Water Quality Section Washington Regional Office, Groundwater Section Groundwater Section, Central Office Technical Assistance and Certification Unit Non-Discharge Compliance/Enforcement Unit Mark Bissell -Bissell Professional Group Water Quality Central Files NDPU Files 2 NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES RALEIGH WASTEWATER TREATMENT AND RECLAIMED WATER UTILIZATION PERMIT In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO Outer Banks / Kinnakeet Associates, LLC Dare County FOR THE continued operation of approximately 3,1431inear feet of 8-inch gravity sewer, two (2) 134 gallon per minute (GPM) pump stations with duplex pumps, high water alarms, approximately 3,3621inear feet of 4-inch force main and a rotary distribution treatment and disposal facility consisting of a 50,000 gallon per day (GPD) extended aeration wastewater treatment facility, an aerated surge tank with influent bar screen and duplex pumps, 2 parallel diffused air aeration tanks with secondary clarifiers, scum removal, air lift sludge returns, low rate tertiary sand filters, a tablet chlorinator, flow recorder and totalizer, effluent dosing tank, aerated sludge holding tanks, 2 - 80 foot diameter rotary distributors and a standby power supply, and abandonment of all wastewater treatment and rotary distribution facilities, piping, valves, electrical and instrumentation/control systems, and other appurtenances necessary to facilitate construction of the new wastewater treatment, spray irrigation/reclaimed water utilization and low-rate infiltration facilities as described below, and construction and operation of a 350,000 gallon per day (GPD) wastewater treatment and reclaimed water utilization system consisting of a manually cleaned influent bar screen, a 140,000 gallon aerated flow equalization basin with two (2) 243 GPM submersible transfer pumps and a 300 cubic feet per minute (CFM) blower, two (2) 23,985 gallon anoxic zones with two (2) submersible transfer pump and two (2) anoxic mixing pump, a flow sputter box, two (2) coarse bubble aeration basins each sized at 175,000 gallons with four (4) submersible recycle pumps and two (2) 3,000 CFM blowers, two (2) 31,050 gallon clarifiers, a second flow sputter box, a 61,650 gallon aerated sludge holding basin with two (2) decant transfer pumps, a 348 square foot (ft2) travelling bridge filter (23 cells) rated at 0.70 GPM/ftZ, a 1,750 gallon travelling filter backwash return tank with duplex pumps and audible/visual alarms, a turbidimeter, a flow meter, an ultraviolet disinfection system, a 3,057,000 gallon lined 5- day upset pond with a 3,5000 gallon retum pump station with duplex pumps and audible/visual alarms, a groundwater lowering pump station with duplex pumps and audible/visual alarms, a 5,100,000 gallon storage/infiltration pond with a loading rate of 1.49 GPD/ftZ, an irrigation pump station with duplex pumps, audible/visual alarms and amini-weather station, approximately 700,000 ft2 of reuse water irrigation area and all associated piping and appurtenances to serve the Kinnakeet Shores Subdivision Wastewater Treatment Plant with no discharge of wastes to the surface waters, pursuant to the permit adjudication request received September 16, 2002 and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Environment and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until December 31, 2007, shall void Permit No. WQ0002284 issued August 7, 2002, and shall be subject to the following specified conditions and limitations: I. PERFORMANCE STANDARDS Upon completion of construction and prior to operation of this permitted facility, a certification must be received from a professional engineer certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting materials. If this proiect is to be completed in phases and partially certified you shall retain the responsibility to track further construction approved under the same permit and shall provide a final certificate of completion once the entire project has been completed. Mail the Certification to the Non-Discharge Permitting Unit, 1617 Mail Service Center, Raleigh, NC 27699-1617. 2. The Washington Regional Office, telephone number (252) 946-6481, shall be notified at least forty- eight (48) hours in advance of operation of the installed facilities so that an in-place inspection can be made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. unti15:00 p.m. on Monday through Friday, excluding State Holidays. The reclaimed water utilization facilities shall be effectively maintained and operated at all times so that there is no discharge to the surface waters, nor any contamination of ground waters which will render them unsatisfactory for normal use. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions or failure of the irrigation area to adequately assimilate the wastewater, the Permittee shall take immediate corrective actions including those actions that may be required by the Division of Water Quality (Division), such as the construction of additional or replacement wastewater treatment and disposal facilities. 4. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the operation of this facility. 5. This permit authorizes the Permittee to construct and operate the subject wastewater treatment, reclaimed water utilization and low-rate infiltration system. The Permittee shall utilize the irrigation lines in phases 9 through 11 and 17 on a continuing basis prior to spraying in any other phases. The Permittee shall provide written notice to the Division within sixty (60) days of the occurrence of any disputes with property owners in phases 9 through 11 regarding the spraying of reclaimed water on their property. 6. The residuals generated from these treatment facilities must be disposed. in accordance with General Statute 143-215.1 and in a manner approved by the Division. 7. Diversion or bypassing of the untreated wastewater from the treatment facilities is prohibited. The following buffers shall be maintained: a) 100 feet between wetted areas and water supply wells, b) 100 feet between wetted areas and waters classified as SA, c) 25 feet between wetted areas and surface waters not classified as SA (excluding decorative ponds with no outlets), d) 100 feet between wastewater treatment units and wells, e) 50 feet between reclaimed water storage/irrigation ponds and property lines, f) 50 feet between wastewater treatment units and property lines, g) 100 feet between the infiltration storage pond and any private or public water supply source and any streams classified as WS or B, h) 100 feet from mean high water between the infiltration storage pond and any "SA" or "SB" classified surface waters, i) 100 feet from normal high water between the infiltration/storage pond and any other stream; canal, marsh, or coastal waters, j) 100 feet from normal high water between the infiltration storage pond and any Class I or Class II impounded reservoir used as a source of drii~~ig wate~~~ k) 50 feet between the infiltration storage pond and any other lake or impoundment (excluding decorative ponds with no outlets), 1) 50 feet between the infiltration storage pond and any drainage systems (ditches, drains, surface water diversions, etc.) and from any groundwater lowering and surface drainage ditches, m) 50 feet between the infiltration/storage pond and property lines, The Permittee shall provide Reuse Water Public Education Packages to each new and existing customer of the Kinnakeet Shores Subdivision Wastewater Treatment Plant. II. OPERATION AND MAINTENANCE REQUIREMENTS 1. The facilities shall be properly maintained and operated at all times. 2. Upon classification of the facility by the Water Pollution Control System Operators Certification Commission (WPCSOCC), the Permittee shall employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of the wastewater treatment facilities. The operator must hold a certificate of the type and grade at least equivalent to or greater than the classification assigned to the wastewater treatment facilities by the WPCSOCC. The Permittee must also employ a certified back- up operator of the appropriate type and grade to comply with the conditions of 15A NCAC 8G .0202. The ORC of the facility must visit each Class I facility at least weekly and each Class II, III, and N facility at least daily, excluding weekends and holidays, and must properly manage and document daily operation and maintenance of the facility and must comply with all other conditions of 15A NCAC 8G .0202. Once the facility is classified, the Permittee must submit a letter to the WPCSOCC which designates the operator in responsible charge within thirty days after the wastewater treatment facilities are 50% complete. 3. A suitable, year-round vegetative cover shall be maintained on the irrigation areas. 4. Irrigation shall not be performed during inclement weather or when the ground is in a condition that will cause runoff. Adequate measures shall be taken. to prevent wastewater runoff from the spray fields. 6. ~ The facilities shall be effectively maintained and operated as anon-discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. 7. The application rate for the storage/infiltration pond shall not exceed a monthly average of 1.49 GPD/ft`. 8. The application of chemicals to the storage/infiltration pond is expressly prohibited. 9. The application rate shall not exceed a cumulative loading of 161.2 inches over any twelve (12) month period at an instantaneous application rate not to exceed 0.3 inches per hour in irrigation zones Al through A12. 10. No type of wastewater other than that from the Kinnakeet Shores Subdivision Wastewater Treatment Plant shall be sprayed onto the irrigation area. 11. No type of wastewater other than that from the Kinnakeet Shores Subdivision Wastewater Treatment Plant shall be disposed in the storage/infiltration pond. 12. A waste-level gauge, to monitor waste levels in the storage/infiltration pond, shall be installed. This gauge shall have readily visible permanent markings indicating the maximum liquid level at the top of the temporary liquid storage volume, minimum liquid level at the bottom of the temporary liquid storage volume, and top of the dam elevations. Caution must be taken not to damage the integrity of the liner when installing the gauge. 13. Freeboard in the storage/infiltration pond shall not be less than two feet at any time. 14. A protective vegetative cover shall be established and maintained on all earthen basin embankments (outside tce of embankment to maximum pumping elevation), berms, pipe runs, erosion control areas, and surface water diversions. Trees, shrubs, and other woody vegetation shall not be allowed to grow on the earthen basin dikes or embankments. Earthen basin embankment areas shall be kept mowed or otherwise controlled and accessible. 15. All wastewater shall be routed to the five-day holding pond should the limit for fecal coliform (daily maximum concentration of 25 per 100 ml) or turbidity (instantaneous maximum of 10 NTU) be exceeded, until such time that the problems associated with the treatment capability of the wastewater treatment plant have been corrected. The wastewater in the five-day holding pond shall be pumped back to the treatment plant for re-treatment or treated in the five-day pond prior to discharge to the storage pond. 16. If nutrient levels in the drainage ditches contribute to water quality stream standard contraventions, additional nutrient removal units may be required. 17. An automatically activated standby power source shall be on site and operational at all times. If a generator is employed as an alternate power supply, it shall be tested weekly by interrupting the primary power source. The length of time that the standby power unit is operated shall be monitored and reported in the maintenance log referenced in Condition III.8 of this permit. The length of time that the standby power unit is operated due to power outage shall be reported separately from the time that the standby power unit is operated for the purpose of routine exercising. The following conditions apply only whsle the existing system is in operation: 18. The rotary distribution fields shall be raked twice weekly during the months April through October and once a week during the months of November through March. 19. Vegetative growth must be kept out of the rotary distribution areas at all times. All vegetation must be removed manually so that minimal disturbance will occur to the disposal area. 20. The application of chemicals to the distribution field(s) is expressly prohibited. III. MONITORING AND REPORTING REQUIREMENTS 1. Influent flow shall be continuously monitored and daily flow values shall be reported on Form NDMR. The Permittee shall install an appropriate flow measurement device consistent with approved engineering and scientific practices 'to ensure the accuracy and reliability of influent flow measurement. Flow measurement devices selected shall be capable of measuring flows with a maximum deviation of less than 10 percent from true flow, accurately calibrated at a minimum of once per year, and maintained to ensure that the accuracy of the measurements is consistent with the accepted capability of that type of device. Records of flow measurement device calibration shall be kept on file by the Permittee for a period of at least three years. At a minimum, data to be included in this documentation shall be: a. If Groundwater sampling indicates or predicts problems with compliance with of the Groundwater Standards, this permit will be modified to include additional and/or more restrictive limitations. 5 3b. The effluent from the subject facilities shall be monitored, by the Permittee, at the point prior to discharge to the storage/infiltration pond for the following parameters: * Twice per week sampling frequency during the months of June, July and August. During the remainder of the year, these parameters shall be monitored monthly. ** Quarterly sampling shall be conducted during March, June, September and December. *** Triannually sampling shall be conducted during March, July and November. If Groundwater sampling indicates or predicts problems vrith the compliance with Groundwater Standards, this permit will be modified to include additional and/or more restrictive limitations. 4. Any monitoring (including groundwater, surface water, soil or plant tissue analyses) deemed necessary by the Division to insure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. 5. Adequate records shall be maintained by the Permittee tracking the amount of wastewater disposed. These records shall include, but are not necessarily limited to the following information: a. date and time of imgation, b. volume of wastewater irrigated, c. zone irrigated, d. length of time zone is imgated, e. continuous weekly, monthly, and year-to-date hydraulic (inches/acre) loadings for each zone, f. weather conditions, and g. maintenance of cover crops. h. volume of wastewater infiltrated in storage/infiltration pond A flow meter shall be installed on the irrigation line to determine volume of wastewater irrigated. The monthly average infiltration flow rate in the storage/infiltration pond shall be determined by subtracting reuse irrigation flow from the flow into the storage/infiltration pond. Three (3) copies of all operation and disposal records [as specified in Condition III(5)] on Form NDAR-1 and three (3) copies of all effluent monitoring data [as specified in Conditions III(1), III(2), III(3a) and III(3b)] on Form NDMR-1 shall be submitted on or before the last day of the following month. A record shall be maintained of all residuals removed from this facility. This record shall include the name of the hauler, permit authorizing the disposal or a letter from a municipality agreeing to accept the residuals, date the residuals were hauled, and volume of residuals removed. 8. A maintenance log shall be maintained at this facility including but not limited to the following items: a: Daily sampling results including residual chlorine, settleable matter, and dissolved oxygen in the aeration basin and at the clarifier weir. b. Visual observations of the plant and plant site. c. Record of preventative maintenance (changing of filters, adjusting belt tensions, alarm testing, diffuser inspections and cleanings, etc.). d. Date of calibration of flow measurement device. e. Date and results of power interruption testing on alternate power supply. 7 9. A representative annual soils analysis (Standard Soil Fertility Analysis) shall be conducted on Irrigation Zones Al through A12 and the results shall be maintained on file by the Permittee for a minimum of five years. The Standard Soil Fertility Analysis shall include, but is not necessarily limited to, the following parameters: Acidity Manganese Potassium Calcium Percent Humic Matter Sodium Copper pH Zinc Magnesium Exchangeable Sodium Percentage Phosphorus Cation Exchange Capacity Base Saturation (by calculation) 10. Noncompliance Notification: The Permittee shall report by telephone to the Washington Regional Office, telephone number (252) 946-6481, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the wastewater treatment facility which results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a sludge digester; the known passage of a slug of hazardous substance through the facility; or any other unusual circumstances. b. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate wastewater treatment such as mechanical or electrical failures of pumps, aerators, compressors, etc. c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. d. Any time that self-monitoring information indicates that the facility has gone out of compliance with its permit limitations. Persons reporting such occurrences by telephone shall also file a written report in letter form within five (5) days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. IV. GROUNDWATER REQUIREMENTS As long as the rotary distributor disposal system is in service, monitor wells MW-5, MW-6, MW-7, MW-8 and MW-9 (depicted on the attached maps) shall be sampled every February, June and September for the following parameters: Water Level pH Chloride Total Dissolved Solids (TDS) Fecal Coliforms Total Organic Compounds (TOC) Nitrate (NO3) Ammonia Nitrogen Volatile Organic Compounds - In November only using one of the following: (A) Standard Method 6230D, PQL at 0.5 ug/L or less (B) Standard Method 6210D, PQL at 0.5 ug/L or less (C) EPA Method 8021, Low Concentration, PQL at 0.5 ug/L or less (D) EPA Method 8260, Low Concentration, PQL at 0.5 ug/L or less (E) Another method with prior approval by the Groundwater Section Chief Any method used must meet the following qualifications: (1) A laboratory must be DWQ certified to run any method used. (2) The method used must, at a minimum, include all the constituents listed in Table VIII of Standard Method 6230D. (3) :The method used must provided a PQL at 0.5 ug/L or less which must be supported by laboratory proficiency studies as required by the DWQ Laboratory Certification Unit. Any constituents detected above the MDL but below the PQL at 0.5 ug/L must be qualified (estimated) and reported. If any volatile organic compounds are detected by the methods listed, then the Washington Regional Office Groundwater Supervisor, telephone number (252) 946-6481, must be contacted immediately for further instructions regarding any additional follow-up analyses required. The results of all initial and follow-up analyses must be submitted simultaneously. The measurement of water levels must be made prior to sampling for the remaining parameters. The depth to water in each well shall be measured from the surveyed point on the top of the casing. The measuring points (top of well casing) of all monitoring wells shall be surveyed to provide the relative elevation of the measuring point for each monitoring well. )f TOC concentrations greater than 10_mg/1 are detected in any downgradient monitoring well, additional sampling and analysis must be conducted to identify the individual constituents comprising this TOC concentration. If the TOC concentration as measured in the_background monitor well exceeds 10 mg/1, this concentration will be taken to represent the naturally occurring TOC concentration. Any exceedances of this naturally occurring TOC concentration in the downgradient wells shall be subject to the additional sampling and analysis as described above. The results of the sampling and analysis must be received on Form GW-59 (Groundwater Quality Monitoring: Compliance Report Form) by the Groundwater .Section, Permits and Compliance Unit, 1636 Mail Service Center, Raleigh, N.C. 27699-1636 on or before the last working day of the month following the sampling month. Prior to initial operation of the new wastewater treatment and reclaimed water utilization system, the existing groundwater monitoring wells (MW-5, MW-6, MW-7, MW-8 and MW-9) shall be permanently abandoned. The well shall be abandoned either by a North Carolina-certified well contractor, the property owner, or the property lessee according to North Carolina General Statute §87-94.4(b)(2). If the well abandonment is not performed by a North Carolina-certified well contractor, the property owner or lessee shall physically perform the actual well abandonment activities, and the well shall be abandoned according to 15A NCAC 2C .0113 (i.e., "Abandonment of Wells") and any applicable local rules. Within 30 days of the well abandonment activities, a "Well Abandonment Record" (i.e., GW-30 Form) shall be completed for the abandoned well and mailed to NCDENR-DWQ, Groundwater Section, Permits and Compliance Unit, 1636 Mail Service Center, Raleigh, NC 27699-1636. 3. Spray irrigation waste application activities should not occur when the vertical separation between the point of application and the water table is at less than one (1) foot. Verification of the water table elevation should be confirmed by water level readings obtained from groundwater monitoring well(s) near the wetted area of the spray irrigation facilities or auger boring(s), which should be performed prior to application of wastewater effluent. Any open boring(s) shall be properly filled in according to 15A NCAC 2C .0113(b)(1)(G) to decrease the chance of any waste contaminating the groundwater. 4. The 5-Day Pond shall have either a liner of natural material at least one (1) foot in thickness and having a hydraulic conductivity of no greater than 1 x 10"6 centimeters per second when compacted, or a synthetic liner of sufficient thickness to exhibit structural integrity and an effective hydraulic conductivity no greater than that of the natural material liner, according to 15A NCAC 2H .0219(f). The COMPLIANCE BOUNDARY and REVIEW BOUNDARY for the waste disposal area(s) is specified by regulations in 15A NCAC 2H, Waste Not Dischazged to Surface Waters, specifically .0219(k)(1)(C)(i)(II)). The Compliance Boundary and the Review Boundary for groundwater shall be established at the property boundary. An exceedance of Groundwater Quality Standards at or beyond the Compliance Boundary is subject to immediate remediation action according to 15A NCAC 2L .0106(d)(2). 6. Prior to waste disposal, the spray patterns of each spray head shall be tested and examined to ensure that the application of the reuse water is limited to the intended areas of application. The Groundwater Section will recommend immediate monitor well installation and the initiation of a monitoring program if the character of the effluent changes, the monitoring is performed less frequently than required, or the applicant fails to monitor/submit the results in a timely fashion. V. INSPECTIONS 1. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 2. The Permittee or his designee shall inspect the wastewater treatment and disposal facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. -The Permittee shall keep an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for a period of three yeazs from the date of the inspection and shall be made available upon request to the Division or other permitting authority. Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premis~~~ or place on or related to the disposal site or facility at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be maintained under the terms and conditions of this permit, and may obtain samples of groundwater, surface water, or leachate. VI. GENERAL CONDITIONS 1. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The Operational Agreement between the Permittee and the Environmental Management Commission is incorporated herein by reference and shall be a condition of this permit. Noncompliance with the terms of the Operational Agreement shall subject the Permittee to all sanctions provided by North Carolina General Statutes § 143-215.6A to § 143-215.6C for violation of or failure to act in accordance with the terms and conditions of this permit. 4. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 5. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 6. The issuance of this permit does not exempt the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction, including but not limited to applicable river buffer rules in 15A NCAC 2B.0200, erosion and sedimentation control requirements in 15A NCAC Chapter 4 and under the Division's General Permit NCGO10000, and any requirements pertaining to wetlands under 15A NCAC 2B .0200 and 2H .0500. 7. A set of approved plans and specifications for the subject project must be retained by the Permittee for the life of the project. 8. The annual administering and compliance fee must be paid by the Permittee within thirty days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15 NCAC 2H .0205 (c)(4). 9. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if warranted, will extend the permit for such period of time and under such conditions and limitations as it may deem appropriate.
