Hello All:
I just wanted to summarize my recollection/interpretation of our 23 May 2006 meeting in the Archdale
Building's conference room 14b. If I have incompletely summarized or inaccurately described any part of
the meeting please Reply to All so that we're all coming from the same page and I can address all
appropriate concerns/considerations.
Attendees:
Myself, Agent representing Avon/Kinnakeet Sand Mine (Ray Hollowell, Owner), RJG&A Restoration
Ecologist
Cyndi Karoly, DWQ 401 Program Supervisor
Thomas Reeder, DWQ Wetlands and Stormwater Branch Head
Floyd Williams, DLR Mining Specialist
Mell Nevils, DLR Chief
John Payne, Assistant Attorney General, Environmental Division
John Hennesy, DWQ DOT Permitting Supervisor, arrived near the meeting's end.
Pursuant to 15A NCAC 02B .0226 Exemptions From Surface Water Quality Standards, DWQ will present
a proposal to the Environmental Management Commission's (EMC) Water Quality Committee on 12 July
2006. The Committee will develop their recommendation and present it to the full EMC during the 13 July
2006 meeting. The request will be presented again at that time.
In order for the proposal to be presented DWQ (Cyndi) must be provided a draft presentation package on
or before 15 June 2005 (four hardcopies and a CD in Word or other editable format). This needs to
include:
• proposed project summary, maps( clearly showing CAMA jurisdictional boundary), and supporting
documentation
• a mitigation plan (describes proposed restoration design methodology in detail (e.g. proposed
topography, hydrology, and plant materials), fee-in-lieu-of percentage, and proposed preservation
percentage and location)
• an alternatives analysis (e.g. why dredged material from off the coast can't be used, why material
can't be trucked in, why upland areas can't be used). (Mr. Hennesy pointed out that such
information may be present in the NC 12 EIS)
• letter(s) from DOT summarizing how much sand will need to be stored in the stockpile per year
Conditions of Approval:
(1) The mine will not have any more material available in storage than NCDOT anticipates needing
annually. (2) It will supply only NCDOT with sand removed from the permit expansion area (i.e. no
material to be sold to any other group/individual)
Also, a revised permit expansion application needs to be submitted to DLR. This does not have a
deadline. Floyd Williams and Mell Nevils indicated that, pursuant to their 5 March 2002 letter, the revised
application should include:
• responses to review agency comments

proof of appropriate notification of adjacent landowners (parcels touching the proposed expansion
area (including across a road) and/or within 1,000 feet of expansion area if another property of yours
is immediately adjacent)
a signed authorization letter allowing me to act as an approved agent
• a properly calculated bond
If significant neighbor comment is received in response to the notification, DLR could require a public
hearing. The EMC presentation/request will satisfy all other public notification requirements
