TENNYSON Secretary Subject: Modification Request for Sections 404 & 10 Individual Permit & Section 401 Water Quality Certiiication for the replacement of Bridges No.12, 18 & 42 on NC 11 over the Cape Fear River and Overflow; Federal Aid No. BRSTP- 0011(9).TIP Project No. B-4028. Debit $570.00 from WBS No. 33395.2.2. References: Section 401 Water Quality Certification Permit dated January 11, 2012. Sections 404 and 10 Individual Section Permit May 16, 2012. Sections 404 and 10 Individual Section Permit Modification issued June 19, 2012. The North Carolina Department of Transportation (NCDOT), Division of Highways requests a Modification of the Individual Permit, U.S. Arrny Corps of Engineers Action ID SAW-2002- 00645 and associated Section 401 Water Quality Certification. The Department has recognized that drift is accumulating at the bents within the Cape Fear River. The bents consists of 2 sets of 6 pipe piles (18" diameter) driven into the river bed with 13.5' x 16.5' concrete footer elevated above normal water surface elevation. When the Cape Fear River rises due to upstream runoff, drift while flowing downstream builds up on the river bents. The drift can entangle with the pipe piles which will cause severe damage. The Resident Engineer's Office has engaged the Bridge / Structure Design Group, Hydraulics, Geotechnical Units and the contractor HRI Bridge, Ine., to develop a system that will ultimately protect the river bents. Please reference the attached plans. A debris deflector will be installed at the bents to eliminate the entanglement of drift. At Bent 1, Marine Sheeting will be driven into the river bed approximately 22' which will be below the elevation of Critical Scour. The sheeting will extend from the toe of slope of the river on the upstream along the two footers and then back into the toe of slope of the river which coincides with sheeting that was previously installed to protect the existing bent outside of the river. Class 2 rip-rap stone with Class B stone will be placed between the concrete footers and the river bank. The rip-rap will extend to the end bent where rip-rap has already been placed. Between the sheeting and the concrete footer, sedimeni will accumulate and eventually fill in the void. A total Open Water Impact of 1,785 sq. ft. The upstream deflector will be constructed using Marine Sheeting driven into the river bed approximately 20' which is below the elevation of Critical Scour. Once installed, the deflector will be filled with #57 aggregate and capped with concrete. Marine Sheeting will also be driven along the sides of the concrete footers so drift cannot get caught in the sides. The downstream will not be enclosed so that Bridge Maintenance Unit can inspect the pipe piles. A total Open Water Impact of 579 sq. ft. (0.01 acre) will be t•equired. Regulatory Approvals Section 404: We are hereby requesting modifications described above for the USACE Sections 404 and 10 Individual Section Permit issued May 16, 2012 (SAW 2002-00645) for the above described activities. Section 401: We are hereby requesting a modifcation to the 401 Individual Water Quality Certification from NCDEQ issued January 11, 2012 (DWR Project No. 110984). In compliance with Section 143-215.3DE of the NCAC, we will provide $570.00 to act as payment for processing the Section 401 Permit Modification.
