Alan Dear Commission members: The Environmental Commission decided at its meeting on Thursday to defer action on a variance for Kinnakeet Sand Mine until September, with the understanding that this would not cause any delay in the issuance of a mining permit by the Division of Land Resources. In the interim, the Division of Water Quality and the Division of Land Resources plan to hold a joint public meeting to receive comments about conditions that might be attached to a variance (should we decide to proceed), as well as comments on the permit. Some in the General Assembly and the Department of Transportation would very much like for us to act on this issue before September so that if the expansion is approved, it would allow the stockpiling of sand for the current hurricane season to begin as soon as possible. The Department has evaluated its options for moving forward on this issue and determined that it can meet legal obligations with a joint public meeting being held on August 3rd (see notice below). We will close the comment period for the variance at the close of business on August 4th, but comments on the mining activity (to be handled by DLR) will be accepted until August 14th. Depending on the comments, a decision on the permit could occur in a matter of days. To accommodate this accelerated schedule, Dave Moreau has asked me to inform you that he is calling a special meeting of the EMC to be held by a teleconference call during the week of August 7th. Please let Lois know as soon as possible the times during the week of August 7 that you could participate in a one hour conference call. We will choose the time that allows the greatest participation of EMC members and send you further information regarding the details of this action. PUBLIC NOTICE is hereby given that Mr. Ray E. Hollowell and the Avon/Kinnakeet Mine, LLC have applied to the North Carolina Environmental Management Commission (EMC) and Water Quality Committee (WQC) for asite-specific Variance from the Wetland Water Quality Standards under the provisions of ijA NCAC 2B .0226 and a modification of Avon/Kinnakeet Mine, LLC's Mining Permit No. 28-16 to add 11.62 acres of land to the existing mining permit. The activity for which this Variance is sought is to excavate 6.16 acres of 404 jurisdictional wetlands (freshwater maritime shrub and grassland) in order to expand the existing Avon Sand Mine on Hatteras Island in Dare County. Mined materials are to be used to stockpile sand material for use exclusively by the North Carolina Department of Transportation for maintenance and hurricane recovery operations on Hatteras Island. Compensatory mitigation is proposed to replace wetlands impacted at a 2:1 ratio through a combination of wetlands restoration, creation, preservation, and payment to the state in-lieu fee program (Ecosystem Enhancement Program). The public is hereby notified that that the Division of Water Quality and Division of Land Resources will hold a joint Public Meeting per the directions of the EMC on Thursday, August 3, 2006 starting at 7 p.m. at the auditorium in the First Flight High School, ioo Veterans Drive, Kill Devil Hills, North Carolina. The public is invited to review the application materials and comment in writing on the above-mentioned application as well as during the Public Meeting. Speaking times will be determined on the day of the meeting depending upon the number of speaking slots requested. Those wanting to speak need to register at the meeting and speaking sequence will be in order of registration. Written comments may be forwarded at any time before or after the meeting provided they are received by the Division of Water Quality no later than close of business August 4, 2006. Additional comments regarding the modification of the mining permit maybe sent to Mr. Floyd Williams, State Mining Specialist, 1612 Mail Service Center, Raleigh, North Carolina 27699-1612 until the close of business on August 14, 2006.
