This matter has not been resolved with the Corps. They have agreed to purchase the credits, however until
they actually do so it remains in non-compliance. Additionally their statement that the proposed project has
been determined by the Corps to be the LEDPA is unfounded. I have not yet evaluated whether the project is
the LEDPA under the guidelines as the project is in non-compliance. Please let me know if you have any
questions.
