RE: Request to Resubmit 401 Major Permit Application for The Willows Phase I
Leland, Brunswick County, NC
Dear Jennifer,
Pharmlogic, LLC (herein referred to as the "Applicant"), has submitted an application for a U.S. Army
Corps of Engineers (USACE) Individual Permit (IP) and to the NC Division of Water Resources (DWR)
for a Major Certification, which are necessary to facilitate the construction of the extension of Curran
Court, within the existing Willows subdivision, located in Leland, Brunswick County, North Carolina.
On 19 April, SEGi requested the application be withdrawn, in order to resolve the non-compliance issue
with the USACE. This matter has been resolved with the USACE. The resolution consisted of making
payment, within 60 days of the date of agreement, to the Lower Cape Fear Mitigation Bank, for 0.30 acre
of non -riparian wetland restoration credit. No changes to the project have taken place since the
application was submitted originally. The proposed project is the least environmentally damaging,
practicable alternative (LEDPA) and, to SEGi's knowledge, has been deemed such by the USACE. That
being the case and with this correspondence, SEGi is resubmitting the application to the DWR for their
review and processing.
