Immediately,after_the_event,Aqua contacted the regional office to make them aware of the•situation and advised them thatit no choice other than to re- route the flow from the,lower plant to the upper plant via emergency pumps. That same month,Aqua hired Freese &Nichols'to evaluate and engineer a permanent plan. While anticipating that a plan would be developed soon,Aqua went forth with submitting its Permit Renewal Application to ensure that it met the statutory requirement of submitting the application six (6) months prior to expiration. Now that it has received the final plan from Freese and Nichols, Aqua concludes that it is not economical to repair or rehabilitate the lower plant for complete waste water treatment, but instead use the lower plant for Flow Equalization, and rely on the majority of the secondary treatment to take place at the upper plant.
