On December 14, 2015, the Division of Water Resources (Division) received your application
dated December 11, 2016, requesting a Major Variance from the Division for the subject project.
The Division has determined that your application is incomplete and cannot be processed. The
application is on -hold until all of the following information is received:
Your application indicates that you plan to purchase buffer mitigation credits from either
a private mitigation bank or the Division of Mitigation Services (DMS) to mitigate for the
proposed 37,577 buffer impacts listed in your variance application per Section C. A
statement of buffer mitigation credit availability from Wildlands Hydrology for 63,435
buffer credits was received by the Division on February 8, 2016. Please provide
documentation from an appropriate mitigation bank or DMS indicating their willingness
to accept your request to purchase 28,767 buffer credits to provide a complete
mitigation plan.
Pursuant to 15A NCAC 02B.0233, the applicant shall furnish all of the above requested
information for the proper consideration of the application. Please respond in writing by
sending two copies of all of the above requested information to the 401 & Buffer Permitting
Branch, 1617 Mail Service Center, Raleigh, NC 27699-1617.
Please be aware that you have no authorization under the Buffer Rules for this activity and any
work done within the riparian buffer may be a violation of North Carolina General Statutes and
Administrative Code.
