Chesleigh Estates Subdivision
Dear Mr. Wynn:
On March 2, 2016, the Division of Water Resources (Division) received your application dated
March 1, 2016 requesting a 401 Water Quality Certification and Riparian Buffer Authorization
from the Division for your project. The Division has determined that your application is
incomplete and cannot be processed. The application is on -hold until the following
information is received:
1. Provide the cross section detail of the proposed road crossing showing the provision for
aquatic life passage that is a requirement of Water Quality Certification Number 3890.

2. The application states that permits or certifications have not been requested or
obtained for this project (including all prior phases) in the past, but our records indicate
otherwise. On May 15, 2006, Chesleigh Subdivision in Granville County obtained a 401
Water Quality Certification to impact 296 linear feet of intermittent stream. As a result,
the U.S. Army Corps of Engineers may consider the current request to impact 142 linear
feet of stream to'be cumulative and may require mitigation for this impact. If the Corps
of Engineers determines that mitigation is required, the Division would need to see a
mitigation plan in order to process this application. [15A NCAC 02H .0502(h)]

Pursuant to Title 15A NCAC 02H .0502(c) and Title 15A NCAC 026 .0233 (8), the applicant shall
furnish all of the above requested information for the proper consideration of the application.
If all of the requested information is not received in writing within 30 calendar days of receipt
of this letter, the Division will be unable to approve the application and it will be returned. The
return of this project. will. necessitate reapplication to the Division for approval, including a_
complete application package and the appropriate fee.
Please respond in writing within 30 calendar days of receipt of this letter by sending four copies
of all of the above requested information to the 401 & Buffer Permitting Unit, 1617 Mail Service
Center, Raleigh, NC 27699-1617.
Please be aware that you have no authorization under the Water Quality Certification Rules or
the Neuse Riparian Buffer Rules for this activity.
