This correspondence is in reference to the Cripple Creek Stream and Wetland Mitigation
Bank you are developing located east of Roney -Lineberry Road, north of Woodbrooke Drive,
south of Deep Creek Church Road and west of North Fonville Road, in northeast Alamance
County, North Carolina, within the Cape Fear River Basin, Hydrologic Unit Code (HUC)
03030002. The purpose of this letter is to confirm the release of additional wetland credits from
this Bank.
The release of these additional credits results from wetlands that have formed on the site, but
were not shown in the final mitigation plan received on March 3, 2009. During the Year 1
Monitoring site visit conducted on November 28, 2011, the United States Army Corps of
Engineers agreed to consider the potential release of additional wetland credits for this area,
providing that Restoration Systems, LLC installed a wetland hydrology monitoring well and
provided data for a period of 5 years. Based on our March 8, 2016, field verification of the
wetland/upland boundary for the 0.51 acre wetland area and our review of five (5) years of
wetland hydrology monitoring for the area, we have determined to release additional credits
associated with the 0.51 acre wetland area.
Pursuant to the Mitigation Banking Instrument (MBI) entitled, Cripple Creek Stream and
Wetland Mitigation Bank, dated December 1, 2009, eighty percent (80%) of the wetland
restoration credits associated with the additional wetland area shall be available for sale
immediately. To date, 80% of the total wetland credits have been released. As such, the release
of 80% of the additional wetland credits, at this time, will k to the existing release schedule.
By copy of this correspondence, we confirm that you have satisfied the agreed upon
requirements and 0.408 additional riparian wetland mitigation credits (rWMCs) are now
available for sale. To date, 85 percent of the total stream credits (3813.95 SMCs) have been
released and 80% of the total wetland credits (5.528 rWMCs and 1.16 nrWMCs) have been
released. Our records indicate that 3140.5 SMCs, 4.52 rWMCs and 0.67 nrWMCs have been
debited from the Bank. Therefore, the current total amount of credits available is 673.45 SMCs,
1.008 rWMCs and 0.49 nrWMCs. Please confirm all of these totals on your mitigation bank
ledger.
