Please see our responses below: 1. Impact Justification: I am attaching a color coded site plan of our property so you can see clearly the existing conditions we have to work with - see Site2Perdue pdf. Pink is the stream buffer measured from the bank which is eroding around the current culvert), blue is the sewer easement and the diagonally dashed rectangle is the proposed structure. Jakub and I keep reevaluating the solutions as we learn more about the constraints we have to work with. To minimize impact we are proposing to build a structure with smaller footprint, thus needing a much shorter culvert extension than initially requested. After installing the catch basement at the end of existing culvert we will need 13'-15' in order to gently slope the ground over the extension towards the head wall or rock bank reinforcement (see attached Culvert Extension pdf). As you can see from the site plan by minimizing the footprint only 1/2 of the proposed structure would be impacting the stream buffer in this solution. We believe that the way the current culvert is installed is incorrect and it brings to unsightly erosion that is jeopardizing the mature trees growing right on the stream bank. If installed properly following your guideline the proposed culvert extension should take care of the erosion problem, stabilize the stream banks and protect the trees. 2. Sequence of work: Selection of a general contractor is pending on the approval of our application, so we haven't taken that step yet. We are planning on employing the services of a contractor who has experience with such work and will perform it in professional manner compliant with your regulations. Here is a proposed sequence of work: First the GC will construct a coffer dam, see Proposed Site Work pdf for coffer dam location. He will temporary divert the stream over Perdue Place Dr. Next he will install the catch basin, the culvert extension, the head wall or rock bank reinforcement, and then he will take apart the coffer dam and the temporary water pipe over the street. New dirt infill area will be planted with native species. This is just a general outline, we can work out the specifics in detail if the proposed work is approved. Please provide a construction sequence and associated details that illustrates the method of dewatering to be utilized at the site and the sequence of construction events to be followed to ensure compliance with this condition. \[15A NCAC 02H .0502(b)(3)\] Pursuant to Title 15A NCAC 02H .0502, the applicant shall furnish all of the above requested information for the proper consideration of the application. If all of the requested information is not received within 30 calendar days of receipt of this email, the DWR will be unable to approve the application and it will be returned. The return of this project will necessitate reapplication to the DWR for approval, including a complete application package and the appropriate fee.
