I took a look at the area this afternoon and I do not see any "boulder- mediated" issues for T&E species. I did not see any large boulders in the creek, and I am OK with them being removed from the OHW boundary. I am more concerned about getting the disturbed areas stabilized as soon as possible and getting erosion control measures up running. I want to make sure that any damages to the erosion control fencing are repaired/replaced. Is a schedule in place to inspect the erosion control BMPs? Unless someone requests it, I do not plan on attending a site visit this Friday. I will be out of the office tomorrow, but call my cell anytime: 919.946.0874 Regards, Byron Byron Hamstead Fish and Wildlife Biologist USFWS Asheville Field Office 160 Zillicoa St., Suite B Asheville, NC, 28801 828-258-3939 ext. 225 This email correspondence an any attachments to and from this sender is subject to the Freedom of Information Act and may be disclosed to third parties. Looks like the pretty much all the boulders are out of the creek, might still be a few smaller ones. Also looks like the contractor pulled the vast majority off the banks as well. Take a look at the photos but I don’t really see much of an issue here. They should throw some seed out in a few places and they still have the sewerline corridor to dress up and seed but hard to really point at any 404/401 issues of significance. Please let me know if we are still on for meeting at the site on Friday morning at 9.30. 1 Thanks, John John Vilas Program Services Manager - Environmental 468 New Market Blvd. Suite B | Boone, NC 28607 Phone: 828.386.1920 | Cell: 828.964.3962 | Fax: 828.386.1923 john.vilas@mcgillengineers.com | www.mcgillengineers.com From: Moore, Andrew W \[mailto:andrew.w.moore@ncdenr.gov\] Sent: Tuesday, April 19, 2016 3:20 PM To: Hamstead, Byron <byron_hamstead@fws.gov>; John Vilas <john.vilas@mcgillengineers.com> Cc: Elliott, William A SAW <William.A.Elliott@usace.army.mil>; Jones, Scott SAW <Scott.Jones@usace.army.mil> Subject: RE: East Yancey WWTP & Sewer Improvements Byron, The two pictures I provided to William are attached. Alternatively, I can do a solo site visit tomorrow to weigh in on potential ESA/elktoe issues. Based on the information provided, I do not have major concerns with removing the remaining boulders from the OHW boundary, but it would be good for me to have some more info. 3 Andrew or William, Can you send me the site photos referenced in your April 18 email? They did not make it to the email sent to me. Also, please send a site location and/or any other project info. I haven't been to the site but my understanding is that the contractor has moved the boulders back onto the bank and was wanting to know if he could leave them. I'm not really seeing this as a good option, so unless there is an objection, I can go ahead and coordinate him getting all the remaining boulders removed from the boundary of OHW - ASAP. If this works with everyone, I'll get moving on this and visit the site to make sure there are no complicating issues. The complaint was in regard to boulders, created during blasting activities associated with sewer line installation, being deposited within Little Crabtree Creek. I conducted a site visit last week and observed several boulders along the banks of Little Crabtree Creek, and some within the water. No water quality violations were noted as a result of the boulders, but note that those incidental impacts were not permitted. See attached pics and feel free to contact me if you have any questions.
