1. The Corps of Engineers believes that there may be jurisdictional waters of the
United States on the subject site, and the perrnit applicant or other affected party
wt�o requested this preliminary JD is hereby advised of his or her option to
request and abtain an approved juri�dictional determination (JD) for that site.
Nevertheless, the permit applicant or o#her person who requested this
preliminary JD has declined ta exercise the option to obtain an approved JD in
this instance and at this time.
2. In any circumstance where a permit applieant obtains ar� individ�al permit, or
a Natianwid� General Permit (NWP) or other g�neral permit verification requiring
"pre-construction notificatian" (PCN}, or requests verification for a nan-reporting
NWP or other general permit, and the permit applicant has not requested an
approved JD tor the activity, the permit applicant is hereby made aware af the
following: �1) the permit a�piicant has elected to seek a perrnit autharization
based on a prelim�nary JD, which does not make an official determination of
jurisdictional wat�rs; (2) that the applicant has the option to request an approved
JD before accepting the terms and conditions of the permit autharization, and
that basing a permit authorization on an appraved JD could passibly result in less
compensatory mitigation being required ar difFerent special conditions; (3) that
the applicant has the right to request an individuaf permit rather than accepting
the terms and concfitions of #he NWP or other genera! permit authorization; {4)
that the applicant can accept a permit aut�orization and thereby agree to comply
with all the terms and canditiarrs of that �ermit, including whatever mitigation
requirements the Corps has determined to be necessary; (5} that undertaking
any activity in reliance upon the subject permit autharization without requesting
an approved JD canstitutes the applicant's acceptance of the use of the
preliminary JD, but that either form of JD will be processed as soon as is
practicable; (6) accepting a permit authorization (e.g., signing a proffered
individual permit} or undertaking any activity in reliar�ce on any form of Corps
permit authorization based on a preliminary JD constitutes ag�eement that all
wetlands and other water bodies on the site affected in any way by that activity
are jurisdictional waters of the United States, and precludes any challenge to
such jurisdiction in any administrative or judiciai compliance ar enforcemenf
action, or in any administrative appeal or in any Federal court; and (7) whether
the applicant elects to use either an approved JD or a preliminary JD, that JD
will be processed as soan as is practicable. Further, an approved J�, a praffered
individual permit (and alf terms and conditions contained therein), or individual
p�rmit deniaC can be administratively appealed pursuant ta 33 C.F.R. Part 331,
and that in any administrative appeai, jurisdictional issues can be raised (see 33
C.F.R. 331.5(a){2)). If, during that administrative appeal, it becomes necessary
to make an official determinatian whether CWA jurisdiction exists over a site, or
to provide an official clelineation of jurisdictiana! waters on the site, the Corps will
pravide an appraved JD to accompiish that resuit, as soon as is practicable.

This pr�lim�nary JD finds that there "may be" waters of the United States on th�
subject project site, and identifies al! aquatic fea#ures on the s�fe that could be
affected by the praposed activity, based on the followir�g information:
