JAY ZIMMERMAN Director DWR #16-0335 Wake County On April 5, 2016, the Division of Water Resources (Division) received your application dated April 4, 2016 requesting a 401 Water Quality Certification and Riparian Buffer Authorization from the Division for your project. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until the following information is received: 1. The wetland, stream, and riparian buffer impacts requested in this application need to be clearly shown and enumerated on the site plan. These impacts need to correspond to the impacts requested in the application. The labels on the site plan should be clear and should match the labels of the impacts listed in the application. As the application and impact maps currently stand, it is not possible to match up what is in the application with the site plan. [15A NCAC 02H .0502(g)] 2. There are also inconsistencies with the stream impacts listed in the application with those on the site plan. For example, the application lists Stream A impact as -113.3 linear feet, but the site plan has on-site Stream Impact A as both 93.3 and 30.7. Stream Impact C is listed as 133.7 linear feet in the application, but the site.plan has the impact indicated as 22.5 linear feet. In addition, all requested impacts in an application should be listed within the impact table and not in the comment section of the table. [15A NCAC 02H .0502(g)] 3. The reservation of credits letter for the required stream mitigation needs to be included with the application. [15A NCAC 02H .0502(h)] 4. The overall imperviousness of the project is listed as 14.46 %, but based on the site plan, the imperviousness of the project appears much larger. [15A NCAC 02H .0502(g)] Pursuant to Title 15A NCAC 02H .0502(c) and Title 15A NCAC 0213 .0233 (8), the applicant shall furnish all of the above requested information for the proper consideration of the application. If all of the requested information is not received in writing within 30 calendar days of receipt of this letter, the Division wilt be unable to approve the application and it will be returned. The return of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee. Please respond in writing within 30 calendar days of receipt of this letter by sending four copies of all of the above requested information to the 401 & Buffer Permitting Unit, 1617 Mail Service Center, Raleigh, NC 27699-1617. Please be aware that you have no authorization under the Water Quality Certification Rules or the Neuse Riparian Buffer Rules for this activity.
