JAY ZIMMERMAN Director DWR # 15-1279 Nash County On March 1, 2016, the Division of Water Resources (Division) received your response to our request for additional information dated February 24, 2016 regarding your request for an Individual Water Quality Certification / Buffer Authorization from the Division for the subject project. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: 1. Title 15A NCAC 02H .0506 requires that a proposed activity has no practical alternative by demonstrating that, considering the potential for a reduction in size, configuration or density of the proposed activity and all alternative designs, the basic project purpose cannot be practically accomplished in a manner which would avoid or result in less adverse impact to wetlands. Because the preferred alternative involves the greatest amount of wetland impact, the Division cannot review this alternative until the U.S. Army Corps of Engineers (USACE) determines that this alternative is the least environmentally damaging practical alternative (LEDPA). Please provide correspondence from the USACE indicating which alternative is selected as the LEDPA. 2. Stream impact S3 — 5.48 linear feet is labeled as a temporary impact. This should be classified as a permanent stream impact since the stream will be relocated away from this small section of channel and it will no longer receive upstream flow. 3. Stream impact S1— 462.20 linear feet is labeled as temporary. Since the channel will be filled, this should be classified as a permanent impact. Relocation of the stream will be considered as self -mitigating. Grading and revegetation (fill) in Zone 2 of the buffer is an exempt activity that does not need to be quantified. The stormwater discharge into the buffer from the stormwater BMP is an allowable activity that requires the impact to be quantified for approval. Please remove B2 entirely and revise B3 to limit the impact to the stormwater discharge only. 5. Explain how erosion in Zone 1 from the SW discharge will be prevented. These types of discharges are usually connected to the stream channel unless the discharge is anticipated to be non-erosive. 6. Add a dashed outline of the existing road within the buffer to make the existing use clearly discernable on the buffer impact map. This Office has the following comments regarding the stream restoration design. Please feel free to contact Mac Haupt at 919-807-6476 or mac.haupt@ncdenr.gov if you have any questions regarding the stream restoration design recommendations. a. Green ash should be substituted for loblolly pine in the planting plan. b. Proposed log sills should be installed with footers and/or matting to prevent piping and eventual undermining. Pursuant to Title 15A NCAC 02H .0502(e) / 15A NCAC 02B .0233, the applicant shall furnish all of the above requested information for the proper consideration of the application. If all of the requested information is not received in writing within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be returned. The return of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee. Please respond in writing within 30 calendar days of receipt of this letter by sending three copies of all of the above requested information to the 401 & Buffer Permitting Branch, 1617 Mail Service Center, Raleigh, NC 27699-1617. Please be aware that you have no authorization under the Section 401 of the Clean Water Act/Buffer Rules for this activity and any work done within waters of the state may be a violation of North Carolina General Statutes and Administrative Code.
