Unfortunately, when the creek crossing location was moved, it forces us to perform another “avoidance and minimization” analysis and assessment of any additional impact the modification might cause. To do that, we will need a new or revised PCN which triggers the additional $570 fee. Had the Phase II part of the project only impacted the “less than one acre and less than 150 feet of streams,” we could have allowed the $240 fee. 3.In the revised PCN and drawings, please note for the “Project History” information where the new crossing location is in respect to the original one. 4.In the 401 program, we do not use the Stormwater Management Permit Application Form used by the DEMLR stormwater program. Your PCN form serves that same purpose. 5.You should check the question under Section E(2) to make sure the correct impervious percentage is provided. 6.The O&M form and all information should be submitted to Karen Higgins, Supervisor, 401 and Buffer Permitting Branch, 1617 Mail Service Center, Raleigh, NC 27699-1617. I will not be involved in stormwater permit review after the end of this month. Cory Larsen will be the new, full-time review engineer. I don’t believe the amount of impacts is any different. We just slid the crossing further downstream to help with the design. Mark N. My first question is whether the PCN covered all of the wetlands/streams that are affected in Phase I and II? If so, I don’t think a new PCN will be needed. The stormwater application form that you attached was for a project that would be reviewed by our stormwater staff in DEMLR. They could be the reviewing agency but I don’t think so. We don’t have a similar form and our fee is less. I’ll let you know which to use when I get confirmation. Are you still filling the roll of Stormwater Reviewer? We are ready to submit plans for stormwater review of Stafford Phase 2. I need to know if I need to submit a new PCN. 2 Is the attached form the correct one to use for this permitting? I’m sorry that I did not notice earlier that it was not included. I can’t approve it without that form. It needs to be signed by the owner and notarized. I’ve attached a blank one for you to add the appropriate elevations and then get a signature. You can send the owner the form and have it faxed or scanned and emailed back to me. I will have the letter ready to be signed when I receive the document. Call me if you have questions at 919-807- 6430. It can be faxed to me at 919-807-6494 but give me a call to let me know when to expect it. 3
