I can re-issue it with the correct GC and NW referenced. Please confirm that your
existing 401 is otherwise exactly the same, i.e. there is no revision in the
impacts.

I applied for a NW 40 /GC 3364 on May 19, 2006, for Agricultural Activities,
for a pond for ag use. I paid $275.
On May 25, DWQ issued a 401, without site review.
On May 31, Todd Tugwell visited the site and stated that I should have applied
for a NW 39/GC 3362 - for a pond, and that for a NW 39 with less than 150 if of
impact, no wetland impacts and no buffers, DWQ should not have charged a fee,
and should have recieved a courtesy copy only. We adjusted the location of the
proposed dam to minimize and avoid important stream impacts about 150 feet
upstream.
I would like to reapply for a NW 39 and GC 3362, but I do not feel that my
client should have to pay a fee again. Granted mistakes were made, but I would
hope that there is a way to work this out. The only changes in the application
are due to minimization & avoidance... Please let me know what you think as
soon as you can. Hope the holidays were good for you and yours!
