Director Division of Water Quality Mrs. Carolyn Bustle 279 Woody Lane Weaverville, North Carolina 28787 ~~~~ May 30, 2006 ~O v ~~N ~D 0 2 ~~46 ~T(ANOSAND ST~~gALlry TER BR'~cH Subject: Stream Sediment Problem Below US Highway 19-23 (Future I-26) Buncombe County Dear Mrs. Bustle: On May 21, 2006, Mr. Ed Green, Mr. Roger Bryan, Mr. Paul Wiesner with the North Carolina Department of Transportation and myself met with you and discussed your concerns regarding the large amount of sediment in the small stream (unnamed tributary to Wagner Branch) adjacent to your house. We explained that approximately 40 linear feet of culvert, which carries the stream under US Highway 19-23, had failed due to storm events and a large area of earthen material had been disturbed, depositing some material into the stream. Once the NCDOT discovered the problem with the culvert, they began work to make repairs. The area has temporarily been stabilized and they are now completing the construction to permanently stabilize the area. Based on our discussions on whether to remove the sediment or to let it flush out naturally, the following items were agreed to: 1. ",!COOT will install several stakes in the stream adjacent to your house to help determine if the sediment is accumulating or is being flushed downstream. These stakes will be calibrated in inch increments and will be observed monthly by DOT staff and the measurements recorded. 2. NCDOT and NCDWQ will monitor the sediment movement in the stream after three (3), six (6) and nine (9) months to determine if it is being flushed downstream. If after nine (9) months it is determined that the sediment is not moving downstream, NCDOT will evaluate removal of the sediment.
