Subject: Request for a NW 14 permit/ DWQ certification for the replacement of Bridge # 143 on SR 1123
(Billy Gun Club Rd.) in Bertie County.
The NCDOT requests a NW 14 Permit and corresponding DWQ certification for the replacement
of bridge #143 in Bertie County, NC. The bridge is located on SR 1123 approximately 7 miles south of
Lewiston/Woodville. The bridge spans an unnamed tributary/swamp that flows into Indian Creek
approximately 0.2 miles downstream. The Division of Water Quality classifies Indian Creek as Class "C"
waters, which is also designated an anadromous fish spawning area. Bridge # 143 is currently a steel and
wooden structure that is 46 ft. long by 18 ft. wide. This structure will be removed using NCDOT's
guidelines for bridge demolition and removal. The proposed bridge will be realigned to the south
approximately 30 ft. The new bridge structure will be 50 ft. in length by 30 ft. wide and built with a cored
slab concrete deck, support piles and bents. The proposed alignment will involve building new bridge
approaches that will impact 7,200 sq. ft (0.170 acres) of riverine wetlands. The wetland is under 404 COE
jurisdiction and there are no coastal wetland species within the project area. These impacts will be
mitigated through the EEP and the removal of the old approach fill. The removal of the old approach fill
will result in 0.052 acres of restored riverine wetland. The remaining 0.118 acres will be mitigated through
EEP. The impacts to the wetlands have been minimized to the extent practical for the project area. This
state road SR 1123 provides the only access to approximately 250 acres of agricultural farmland. The
bridge realignment is necessary to keep the road open and provide access for farmers to the land during the
time period of the bridge replacement. The provided permit drawings and project location map show the
wetland impacts and restoration area. NCDOT will also be applying for a LAMA Major permit in
conjunction with this application. Included with this letter are the PCN, permit drawings, photographs and

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans ir. relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps maybe included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires information to be submitted on sheets no larger than 11 by 17-inch format;
however, DWQ may accept paperwork of any size. DWQ prefers full-size construction
drawings rather than a sequential sheet version of the full-size plans. If full-size plans are
reduced to a small scale such that the final version is illegible, the applicant will be informed that
the project has been placed on hold until decipherable maps are provided.

at the time of this application: The existing bride is a 18' X 46` wooden bride with two
interior bents supported by wood piles The existing roadway is a 16-18 ft. Qravel surface
roadway with 4-6 Qrassed shoulders. This bridge crosses a riverine Cyprus-Gum swamp that

drains to Indian Creek approximately 0 3 miles downstream. Indian Creek is classified as a
Class "C" water by the Division of Water Quality and anadromous fish spawmn~ waters by
the Wildlife Resource Commission Landuse within the project area is dominated by forestry
and row crop~riculture
10. Describe the overall project in detail, including the type of equipment to be used: The
existing wooden bride deck and piles will be removed in accordance with NCDOT
guidelines for brirl~e demolition and removal The new bride structure will be placed on

accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial)
should be shown on a delineation map, whether or not impacts are proposed to these systems.

Photographs may be included at the applicant's discretion. If this proposed impact is strictly for
wetland or stream mitigation, list and describe the impact in Section VIII below. If additional
space is needed for listing or description, please attach a separate sheet.

NCDOT will remove the old road bed resulting in 0.052 acres of restored riverine wetland
The remaining balance of 0.118 acres is being proposed to be mitigated through the
Ecosystem Enhancement Program. The old road bed will be graded to match the adjacent
wetland elevation and tilled to reduce compacted soils. Once the roadbed is~repared then
wetland vegetation can be planted and monitored by the Roadside Environmental Division

X. Propased Impacts on Riparian and Watershed Buffers (required by DWQ)
It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
required state and local buffers associated with the project. The applicant must also provide
justification for these impacts in Section VII above. All proposed impacts must be listed herein,
and must be clearly identifiable on the accompanying site plan. All buffers must be shown on a

were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts. Impacts to wetlands have been
avoided through the reduction in the footprint of the relocated roadbed. The realignment of the
road was established at the nearest distance from the existing road that is practical.
This project is unique because the road provides the only access to approximately 250 acres of
agricultural land. It would create a hardship on the farmer to close this road and replace the
bridge on the same alignment Placing the bridge on new aliment to the south will allow
NCDOT to key the road open while the bridge is being replaced. The option of an off-site
detour is not available at this location. The old roadbed will be removed, which will restore
approximately 0 052 acres of riverine wetland. The remaining wetland impact can be miti ag ted
for by using the Ecosystem Enhancement Prog am.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
An applicant may also choose to review the current guidelines for stream restoration in DWQ's
Drab Technical Guide for Stream Work in North Carolina (see DWQ website for most current
version.).

Describe impervious acreage (existing and proposed) versus total acreage on the site. Discuss
stormwater controls proposed in order to protect surface waters and wetlands downstream from
the property. 1f percent impervious surface exceeds 20%, please provide calculations
demonstrating total proposed impervious level. The existing impervious surface consist of the
roadway on SR 1123. This surface tivill be widened a couple feet on either side, so the
impervious surface area wal increase slightly. The water will be directed off the bridge surface
and roadway onto the gassed shoulders. This will maintain the existing diffuse flow off the
shoulder of the roadway.

Clearly detail the ultimate treatment methods and disposition (non-discharge or discharge) of
