Director Division of Water Quality October 21, 2002 Dr. Greg Thorpe, PhD., Manager Planning and Environmental Branch North Carolina Department of Transportation 1548 Mail Service Center Raleigh, North Carolina, 27699-1548 Re: Permit Application for proposed widening of NC55 from US 17 in Bridgeton to NC 304 in Bayboro in Craven and Pamlico Counties DWQ No. 021232, TIP No. R-2539 Dear Mr. Thorpe: The Division of Water Quality has reviewed your submittal fora 401 Water Quality Certification for the aforementioned project. Review of your application revealed it lacking necessary information required for making an informed permit decision. The permit application was deficient in the following areas: • The application does not present any of the anticipated impacts from the relocation of utilities that will be required as a result of the road project. Please provide the location of all utility lines (above and below ground) as well as any associated structures. In addition, please provide the proposed relocation plans for all of the impacted utilities and include the anticipated impacts to all wetlands, streams, and buffers. • The drawings presented in the application do represent the latest available designs. Please provide the most recent designs for the entire project including any changes in proposed impacts to wetlands, streams, and buffers. While DWQ agrees with the proposed onsite wetland mitigation in concept, we require additional information prior to approval. In reference to the document titled "Restoration Plan for Swamp Hardwood Wetlands at Existing Bridge Causeways of NC 55", the information provided regarding the proposed species for planting and the vegetation and hydrologic monitoring plans is insufficient. Please provide a planting plan that lists the species to be planted. In addition, please remove the phrase, "...Depending on availability, the seedling mix will mimic...". Replace the statement to indicate that the NCDWQ will have to approve the list of species to be planted in the sites. Furthermore, the vegetative monitoring will need to continue for 5 years, not the 3 proposed years. Please make changes to that section as well. Finally, the hydrologic success criteria will need to use an on site reference site. The restored site mimicking the reference site within some approved variance will achieve hydrologic success. To coordinate discussion on this issue please contact John Hennessy at 919- 733-5694. The reference site should be located immediately to the restoration area. Please change the proposed plan as described above and resubmit for approval by the NCDWQ. • There is no specific design criteria presented for the proposed onsite stream mitigation in Section B. Please provide all appropriate plans, geomorphological data, sediment transport analysis, planting plans, and monitoring plans. • .The application proposes the use of the Croatan Mitigation Site as off-site non-riverine wetland mitigation. At this time, the NCDWQ has not approved that site for use. We will coordinate with DOT to finalize approval of the site. Please contact John Hennessy at 919-733-5694 to coordinate those efforts. N. Director o ~ • The application does not show the proposed bridge bent locations for the three project bridges. Please provide the proposed locations of the bents and the anticipated impacts. • In reviewing the tables for stream and buffer impacts, it is not clear if the totals presented include anticipated construction impacts. Please clarify and provide additional information as necessary. • The design drawings presented do not provide sufficient information to visually identify proposed project impacts. Please provide additional information that shows the limits of jurisdictional impacts with shading or hatching of impact areas. • The design drawings do not show all the proposed stormwater collection pipes. Please provide additional information that shows all the proposed stormwater collection system and outfalls. Information should be provided at the outfall locations so that DWQ can determine that stormwater discharges will be through riprian buffers as diffuse flow at non-erosive velocities. • Review of Section C indicates that insufficient information is present to allow issuance of the Buffer Certification for this project. Please provide the latest design drawings that were reviewed by DWQ on 10/11/02. Therefore, pursuant to 15A NCAC 2H .0507(a)(5), we will have to place the permit application on hold until we are supplied the necessary information. Furthermore, until the information is received by the NC Division of Water Quality, we request (by copy of this letter) that the US Army Corps of Engineers place the permit application on hold.
