RE: Refinement of LAMA Major Development Permit No. 20-07 {TIP No. R-2245}.
Second Bridge to Oak Island Brunswick County.
Dear Mr. Herndon:
This letter is in response to your email request, dated September 12, 2007, regarding the
modification of the permitted design of the work bridges within the AIWW and additional
excavation of high ground within the Estuarine Shoreline AEC to provide access to the
temporary work bridges. In your email you state that the permitted work bridges as currently
authorized are not accessible by barge and cannot be accessed from land due to the vertical banks
along the shorelines.
Your request proposes to modify the permit to allow for the excavation of a temporary access
road on the south side of the AIWW, beginning in the vicinity of STA. 54+35 and ending at
approximately STA. 56+30. The temporary access road would be graduated down from the
existing elevations to an elevation of +7' at the bulkhead along the AIWW. The request also
proposes to modify the permit to allow the construction of a temporary sheet pile bulkhead
immediately waterward (0.5-1.Oft.) of the existing bulkhead to protect the shoreline and prevent
discharges into the AIWW. Also on the south side of the AIWW, you have requested to shift
the work bridge 20' to the west and eliminate the shore parallel portion of the work bridge.
You have also requested to make several similar modifications to the project on the north side of
the AIWW. Access to the work bridges would be provided by the excavation of a temporary
road, beginning at STA.63+00 and ending at STA.60+75, which would be graded down to an
elevation of +7.5'at the proposed temporary bulkhead along the AIWW. A temporary sheet pile
bulkhead is proposed where the access road joins the temporary work bridges to protect the
shoreline and prevent discharges into the adjacent waterbody. The temporary work bridges on
the north side of the A1WW would also be reconfigured according to the proposal. This would
result in the elimination of the work bridge finger that runs parallel to the shore and result in a
32'x120' work bridge that would be perpendicular with the shoreline.
The request indicates that the sheet piling for the temporary bulkheads and the temporary work
bridges will be removed when construction is complete. The request also indicates that the
access roads will be removed, backfilled, and restored to the natural contours and that the
restored slopes will be stabilized with matting and natural vegetation. If the matting and natural
vegetation are not effective in stabilizing the slopes, the use of rip rap has been proposed in the
request, however no specific details are available or provided in the request.

This Letter of Refinement authorizes the requested additional excavation of high ground,
installation of two temporary bulkheads, and reconfiguration of the temporary work bridges as
described in your request letter dated September 12, 2007, and as shown in two half-size
drawings {dated September 6, 200b and received September 12, 2007). If is determined that the
use of rip rap is required to stabilize the restored slopes along the AIWW, then detailed plans and
specifications concerning the rip rap must be submitted to this Division for additional
authorization. This letter shall be attached to the original of amended LAMA Permit No. 20-07,
which was issued on February 23, 2007 and all documents must be readily available on site when
a DCM representative inspects the project for compliance. All conditions and stipulations of the
active permit remain in force unless altered herein. This Letter of Refinement does not eliminate
the need to obtain any other permits or approvals that may be necessary.
