Dear Mr. Shaver and Mr. Herndon,
On behalf of the North Carolina Department of Transportation (NCDOT) Division 3
environmental officer, Mr. Stonewall Mathis, this submittal serves as a preliminary
jurisdictional determination (PJD) request as well as a pre-construction notification
(PCN) application requesting written concurrence from the US Army Corps of
Engineers (USACE) and the NC Division of Water Resources (NCDWR) that the
activities proposed below may proceed under Nationwide Permit 14 and General
Water Quality Certification (GC) 3886.
Project Purpose and Need
Pebble Beach Drive is currently a soil/gravel roadway. The road improvement project
(Project) plans to upgrade the roadway to state standards which would include
widening and moving roadside ditches, and paving. The project proposes to replace
an existing 48" corrugated metal pipe (CMP) with one 81" x 59" x 50' corrugated
aluminum arched pipe in conjunction with the road upgrade. The existing CMP is
undersized and has deteriorated presenting a safety concern. The proposed
replacement will provide adequate flow to prevent damming and address the existing
safety concerns, while also allowing for aquatic life passage. The project also
proposes to route drainage from the planned cul-de-sac through a drop inlet and rip
rap dissipater pad.
Project Location
Pebble Beach Drive is located approximately 0.75 miles southeast of US 17 in Pender
County (Figure 1). The project area consists of approximately 2.89 acres of right of
way including the roadway (Figure 2). The project begins at the intersection of Pebble
Beach Drive and Doral Drive and extends in a northwestwardly direction for 2,049
feet (0.39 miles).
]urisdictional Features
As per the Natural Resources Conservation Service's Pender County Soil Survey, the
soil series present within the project area are listed in Table 1 below and shown in
Figure 3.

A delineation and evaluation of jurisdictional features within the defined project limits
was conducted by SEPI on April 9, 2015. The evaluation identified one perennial
stream/tributary (SA) and two jurisdictional wetland areas (WA and WF), as shown in
Figure 4. Stream (SA) is classified as (SA;HQW). USGS Topographic imagery of the
site is shown in Figure 5. LiDAR imagery of the site is shown in Figure 6. Photos 1
through 4 of the site are also included.
Proposed Impacts
There are a total of 43 LF of proposed permanent stream impacts for this project
(impact figures attached). Proposed permanent stream impacts resulting from the
pipe replacement, inlet and outlet headwalls and class B rip rap total 31 LF. There are
12 LF of proposed permanent stream impacts resulting from the cul-de-sac drainage
class 6 rip rap dissipater pad. There are a total of 0.08 acres of proposed permanent
wetland impacts associated with this project. Proposed permanent wetland fill
impacts associated with this project are 0.02 acres for the roadway ditches and inlet
rip rap. Proposed permanent wetland excavation impacts associated with this project
are <0.04 acres for the roadway ditches. There are also <0.02 acres of permanent
mechanized clearing in wetlands proposed for the project.
To accommodate the designed flow capacity required by the NCDOT hydraulics unit
one 89" x 59" corrugated aluminum arched pipe is proposed to replace the existing
single CMP. To avoid widening the tributary channel or reducing the depth of the
stream in connection with this construction activity, the box culvert will be aligned
with the channel. The box culvert will be buried at least 1 foot below the natural bed
elevation as determined from upstream and downstream elevations (Permit Drawings
and stream survey table attached). A filter fabric waiver is requested for this site.

NCDOT plans to grade, drain, base, and pave the road. The project proposes to replace an existing 48" corrugated metal

A review of GIS NC Natural Heritage Program (NHP) elemental occurrence data from NHP was completed and a field
survey for federally endangered species was conducted on April 9, 2015. No federally endangered species were found
within the project area and a finding of No Effect was made. A summary memo is attached.

The site crosses the upper-most reaches of the headwaters to a UT to Mullet Run and is separated from the tidal portion of
Mullet Run by a man-made impoundment on a golf course. DCM, WRC and DMF clearance e-mails attached.

1. The Corps of Engineers believes tf�at there may be jurisdictional waters of the
United States on the subject site, and the permit applicant ar other affected party
who requested this preliminary JD is hereby advised of his or her option ta
request and obtain an approved jurisdictional determination (JD) for that site.
Nevertheless, the permit applicant or o#her person who requested this
preliminary JD has declined to exercise the option to obtain an appro�ed JD in
this instance and at this time.
2. In any circumstance where a permit applicant obtains ar� indi�idual permit, or
a Nationwide General Permit (NWP) or other general permit verification requiring
"pre-canstruction notificatian" (PCN), or requests verification for a non-reporting
NWP or other general permit, and the permit applEcant has not requested an
approved JD for the activity, the permit applicant is hereby made aware af the
following: (1) the permit aApficant has elected to seek a permit authorization
based on a preliminary JD, whieh does not make an official determination of
jurisdictional waters; (2) that ihe applicant has the option to request an appraved
JD before accepting the terms and conditions of the permit authorEzation, and
that basing a permit authorizatian on an approved JD could passibly result in less
compensatory mi#igativn being required or different special conditions; {3} that
the applicant has the right to request an individuaf permit rather than accepting
the terms and conditions af the NWP or ather genera! permit autharization; {4)
that the applicant can accept a permi# authorization and thereby agree to compky
with all the terms and canditians af that permit, ir�cluding whatever mitigation
requirements the Corps has de#ermined to be necessary; (5} that undertaking
any activity in reliance upon the subject permit authorization without requesting
an approved JD constitutes the applicant's acceptance af the use of the
preliminary JD, but that either form of JQ will be processed as soon as is
practicable; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps
permit authorization based on a preliminary JD constitutes agreement that all
wetlands and other water bodies on #he site aff�ected in any way by that activity
are jurisdictional waters of the United States, and precludes any challenge to
such jurisdiction in any administrative or judiciai compliance or enforcemenf
action, or in any administrative appeal or in any Federal caurt; and (7) whether
the applicant elects ta use either an approved JD or a preliminary JD, that JD
witl be processed as soon as is practicable. Further, an approved J�, a proffered
individual permit (and all terms and conditions contained therein}, or individual
permit denia[ can be adminis#ratively appealed pursuant to 33 C.F,R. Part 331,
and that in any administrative appeal, jurisdictional issues can be raised �see 33
C.F.R. 331.5(a)(2}). If, during that administrative appeal, it becomes necessary
to make an official cfetermination whether CWA jurisdiction exists over a site, or
to provide an official delineation of jurisdictiona! waters on the site, the Corps will
provide an appraved JD to accomplish thaf resuit, as soon as is practicable.
This preliminary JD finds that there "may be" waters of the United States on the
subject project site, a�d identifies all aquatEc fea#ures on the s�te that could be

An evaluation of natural communities and threatened and endangered (T&E) species
for the NCDOT Road Improvements to SR 1765 (Pebble Beach Rd) beginning at Doral
Drive and extending northwest approximately 0.39 miles, in Pender County included
GIS based review of aerial imagery, USDA soil survey mapping, USGS topographic
mapping and LiDAR imagery; a wetland and stream delineation; review of the North
Carolina Natural Heritage Program (NCNHP) web-based mapping tool; and a field
survey by qualified environmental scientists.
Sixteen federally threatened and endangered species are listed in Pender County by
the US Fish & Wildlife Service (USFWS), including American alligator (T), Bald Eagle
(BGPA), Green sea turtle (T), Hawksbill sea turtle (E), Kemp's ridley sea turtle (E),
Leatherback sea turtle (E), Loggerhead sea turtle (T), Piping plover (T), Red-cockaded
wood pecker (E), Red knot (T), West Indian manatee (E), American chaffseed (E),
Cooley's meadowrue (E), Golden sedge (E), Rough-leaved loosestrife (E) and
Seabeach amaranth (T).
Biological Conclusion: No Effect
Review of the GIS data indicated that habitat for American alligator exists throughout
the project site. The project crosses an unnamed tributary to Mullet Run, a shallow
slow-moving stream that consists of the upper-most reaches of the unnamed
tributary. The project area is separated by the larger swamp system associated with
Mullet Run by a man-made impoundment on a golf course. A field survey of the
project area was conducted on April 9, 2015. No federally listed T&E species in
Pender County were present within the project area.

Project Description: Improve SR 1765 (Pebble Beach Dr.). Upgrade gravel road to state
standards which include widening the roadway, moving ditches, and paving. Area of Potential
Effects (A.P.E.) is approximately 625 meters (2,049 ft.) ]ong and 18 meters (60 ft.) wide.
SUMMARY OF ARCHAEOLOGICAL FINDINGS
The North Carolina Department of Transportation (NCDOT) Archaeology Group reviewed
the subject project and determined.•
� There are no National Register listed ARCHAEOLOGICAL SITES within the project's
area of potential effects. (Attach any notes or documents as needed.)

Br�ief description of review activities, results of review, and conclusions:
The original review of this project (11/10/2015) included the eXamination of a topographic map,
an aerial photograph, and the listings of previously recorded sites, previous archaeological
surveys, and previous environmental reviews at the Office of State Archaeology (OSA). The
review determined that the landforms within the A.P.E. appeared to have some potential for
prehistaric archaeological sites, and recommended an archaeological survey of the well-drained,
undisturbed landforms within the A.P.E
An archaeological survey was conducted by NCDOT archaeologists Scott Halvorsen and Caleb
Smith on 12/17/2015. The A.P.E. is approXimately 697 meters (2,286 ft.) long, and begins at the
intersection with Doral Dr. (referred to as the east end of the project). The road begins at the
edge of an upland overlooking an unnamed drainage way, extends north across the drainage way
for approximately 305 meters (1,000 ft.), turns to the southwest for approximately 250 meters
(820 ft.), then turns to the southeast for approximately 122 meters (400 ft.) to end at the unnamed

drainage way (referred to as the west end of the project). The landform in the A.P.E. is an
upland next to a seasonal drainage way. In general, this landform has a moderate potential for
archaeological sites. There are several previously recorded sites recorded on similar landforms
in the vicinity. The edge of the upland overlooking the drainage way has a higher potential for
prehistoric archaeological sites. The highest potential parts of the A.P.E. are located at the east
and west ends of the proj ect.
Inspection of the A.P.E. found that most of it has a low potential for archaeological sites. The
18-meter (60-ft.) wide A.P.E. is clearly marked by stakes, and includes a narrow strip of land on
each side of the road. Most of the roadside is disturbed by drainage ditches, residential yards,
driveways, and construction sites. Beginning at the east end of the A.P.E., at the intersection
with Doral Drive, the higher potential uplands on each side of the seasonal drainageway are
occupied by homes. Along the rest of the road are several construction sites (not depicted on the
most recent aerial photographs). The only part of the A.P.E. with potential for archaeological
sites is the west end of the project, where the design includes a cul-de-sac and a drainage
easement from the cul-de-sac to the seasonal drainage way. This part of the A.P.E. is located
outside of the disturbance along the existing road and construction sites.
Three shovel tests (STs 1-3) were excavated at a 15-meter (50-ft.) interval in the area of the
proposed cul-de-sac and the drainage easement. This part of the landform had the highest
potential for archaeological sites because it is the edge of the upland overlooking the drainage
way. Each shovel test was excavated to a depth of approximately 60 centimeters (24 inches)
below surface. The soils in the shovel tests consisted of bands of dark gray, brown, and white
sand (see Table below). No artifacts were recovered from any of them.

In summary, the original review for this project recommended an archaeological survey because
the landform within the A.P.E. appeared to have a moderate potential for archaeological sites.
There are several previously recorded archaeological sites on similar landforms (uplands near
water) in the vicinity. However, examination of the A.P.E. found that most of the roadside is
disturbed and has a low potential for archaeological sites. Three shovel tests excavated in an
undisturbed part of the A.P.E. found no archaeological remains. Therefore, no further work is
recommended for this project.

determined that the UT to Mullet Run crossing under Pebble Beach Drive is not located within one of
the Division of Coastal Management's AEC's, therefore, a permit from DCM will not be required for work
that may be needed to bring the road up to state standards. If I may be of any further assistance with
