The esistiug 24' W s 17' L timber bridge needs to be replaced due to deterioratiou. The proposed replacemeut structure �vill be � 16' W s d' H x 46.5' L bottomless concrete box cuh�ert. An off-site detour will be used during construction. The stream bed in the viciniq� of the bridge includes a series of steep bedrock cascades that likely prevent or impede most fish movements. Enclosed are a PCN �pplication, preliminaiy jurisdictioual detennination form, plan sheets showing the proposed �vork, a USGS quad map, phorographs, and other pertinent project information. The North Carolina Natural Heritage Program database was checked for records of thre�tened aud endangered species. There are 51 species listed for Haywood Counq� that have feder�l status. The bog twtle (GI��plemps mrJdenbergii) is Iisted as threatened due to similariq� of appearance to the listed northern bog turtle. Bald eagle (HnNcreeh�s leucocephalus) is listed under the Bald and Golden Eagle Protection Act (HGPA). The only records in Haywood Counq� are from the Pigcon River aud the Io�ver portions of the East Pork Pigeon and West Fork Pigeon rivers upstream of Canton; there are no records from any tributaries to these rivers. With rare exception, gray bats roost in caves year-round and Indiana bats and NLEB winter in caves or mines with stable, but not fi�eezing, cold temperah�res. This project only involves a small bridge replacement, so consh•uction �vork will not extend far fi•om the existing riglit-of-�vay into a��eas where caves wald occw•. There are no caves or mines visible uear the bridge and, according to USGS data, the nearest undergiround mine is over 23 miles away. Therefore, gray bats and hibernating Indiaua bats and NLEB will not be affected by the project. In summer, Indiana bats and NLEB generally roost on structures or imder the loose bark of trees, either dead �vith peeling bark or cavities, or live trees with shaggy bark sucli as �vhite oak, maples, sycamore and l�ickories. The bridge was swveyed on Juue 1, 2015 and there were no roosting bats or any evidence of bat nsage (i.e. staining or guano). The structure is only a few feet above the �vater surface and very cool imderneatli. There are no known NLGB hibernacula or maternity roost t��ees within 0.25 mile or 150 feet, respectively, of the bridge site. Therefore, the project should be consisteut with exceptions for incidental take outliued in the NLEB Fival 4(d) rule. The construction work may require the i�emoval of approsimately 3 trees (>3"dbh) uear N�e bridge. To protect Indiana bats, any obstructing trees will be removed from October 15 to April I S(winter clearing). W ith this measure, �ve recommend a"may affect, not lilcely to adverscly affect" determination for Indiana bat. Small whorled pagonia generally occurs in open, dry, deciduous �voods with acid soil, though habitats can inclnde slopes along streams and mesic forest witli �vhite pine and rhododendron. The nea��est record for tliis plaut is over 8 miles finm the project. Land nse adjacent to tlie bridge consists of maintained road sl�oulders, a farm road, driveway, and pasture. There is wooded habitat near the bridge, but this area is beyond where bridge consh•uction and gradiug work will occur. The Carolina northern flying squirrel, rock gnome lichen, spruce-fir moss spider and spreading avens are found in spn�ce-fir forests and otlier isolated high elevation locations in western No�th Carolina. However, rock gnome lichen is an exception because it can occasionally be found at lower elevations in deep river gorges with high humidity or on some ve��tical rock faces that are periodically wet. The bridge site has an elevation of only 2,480 feet and Iacks rock faces and other habitat conditions required by these species. The project is limited in scope. Erosion and sedimentation control measures �vill be implemented to minimize adverse effects of the �vork on aquatic habitats. Habitats for listed species appear lacking at the project site and noue of these species �vere observed during field visits. For these reasons and those discussed above, �ve recommend that a detennination of "no effect" ou Iisted species apply to this project, except for NLEB and Indiana bat as described above. This project was reviewed by NCDOT's Human Environment Unit in 2011. Surveys were not required for eitlier l�istoric architechu�e or archaeology �vith determinations of "no effecP' (see attached forms). NCDOT best management pr�ctices �vill be used to minimize and control sedimentation and erosiou on this project The constniction foreman �vill review all erosion control measw�s daily to ensure sedimentation and einsion controls are beiug effectively controlled. If the devices are not fimctioning as intended, they will be replaced immediately with better devices. Bridge # 430314 Page 3 April 12, 2016 Haywood County Impacts to Waters of the United States Arrington Branch (DWQ Class: C) is shown ou tlie USGS topographic map as a perenuiel stream. The channel is approximately 8 feet in width and well defined with � substrate of mostly bedrock tivith some sand, silt, and cobble. The sti�eam has sufficient flow to support fisl� and other aquatic life. Arrington Branch flows to the Pigeon River. The Pigeon River meets the definition of a Traditional Navigable Water (T'NW). For these reasons, we believe Arrington Branch is a Relatively Permanent Water (RPW) and is under the jw•isdictiou of the U.S. Army Corps of Engineers. In order to construct the project, it will be necessary to impact wate�s of the United States in the French Broad River Basin (CU 060101�6). Specifically, NCDOT is requesting to replace Bridge No. 314 with a bottomless concrete box culve�t. Listed belo�v is a sommary of the proposed impacts.
