Dear Ms. Beck�vith:
The Noith Caroliva Department of Transportation (NCDOT) is proposing to replace the subject
bridge. The esistiug 24' W s 17' L timber bridge needs to be replaced due to deterioratiou. The
proposed replacemeut structure �vill be � 16' W s d' H x 46.5' L bottomless concrete box cuh�ert.
An off-site detour will be used during construction. The stream bed in the viciniq� of the bridge
includes a series of steep bedrock cascades that likely prevent or impede most fish movements.
Enclosed are a PCN �pplication, preliminaiy jurisdictioual detennination form, plan sheets
showing the proposed �vork, a USGS quad map, phorographs, and other pertinent project
information.
The North Carolina Natural Heritage Program database was checked for records of thre�tened
aud endangered species. There are 51 species listed for Haywood Counq� that have feder�l status.
The bog twtle (GI��plemps mrJdenbergii) is Iisted as threatened due to similariq� of appearance to
the listed northern bog turtle. Bald eagle (HnNcreeh�s leucocephalus) is listed under the Bald and
Golden Eagle Protection Act (HGPA). Nine species, Carolina norlhern flying squirrel
(Glauconi��.s snbrinus colorolus), gray bat (�tLyotis grise,scens), Indiaua bat (iLtpolis sodcdis),
northern long-eared bat (�ll��otis seplerrh•ionnlis, NLEB), Appalachian elktoe (A(osmidon(�r
rareuelinnn), spruce-fir moss spider (il9icrohesura nion�n�ngn), small who�ied pogonia (Isoh•ia
ntetleoloides), spreTding avens (Gei�ni rndio/imt), and rock gnoiue lichen (G�mmodernur linern•e),
�re known from current records �nd are listed as either threatened or endangered. According to
the USP��I�S, FI��m�ood Couuty is now considered occupied summer range for Lidiana bats nnd
NL�B.
Appalachian elktoe are found in some �vell-osygenated streams with moder�te to f�st flowing
water and stable, mi�ed subshates of silt, sand, gr�vel, and/or cobble. Streams (hat suppoit this
mussel are typieTlly much larger than Arringtou Br�nch. The only records in Haywood Counq�
are from the Pigcon River aud the Io�ver portions of the East Pork Pigeon and West Fork Pigeon
rivers upstream of Canton; there are no records from any tributaries to these rivers. The bridge is

0.4 miles upstream of the Pigeon River and Ihis reach of the river is over 19 river miles
do�vnstream of occupied mussel h�bitat.
With rare exception, gray bats roost in caves year-round and Indiana bats and NLEB winter in
caves or mines with stable, but not fi�eezing, cold temperah�res. This project only involves a
small bridge replacement, so consh•uction �vork will not extend far fi•om the existing riglit-of-�vay
into a��eas where caves wald occw•. There are no caves or mines visible uear the bridge and,
according to USGS data, the nearest undergiround mine is over 23 miles away. Therefore, gray
bats and hibernating Indiaua bats and NLEB will not be affected by the project.
In summer, Indiana bats and NLEB generally roost on structures or imder the loose bark of trees,
either dead �vith peeling bark or cavities, or live trees with shaggy bark sucli as �vhite oak,
maples, sycamore and l�ickories. The bridge was swveyed on Juue 1, 2015 and there were no
roosting bats or any evidence of bat nsage (i.e. staining or guano). The structure is only a few
feet above the �vater surface and very cool imderneatli. There are no known NLGB hibernacula or
maternity roost t��ees within 0.25 mile or 150 feet, respectively, of the bridge site. Therefore, the
project should be consisteut with exceptions for incidental take outliued in the NLEB Fival 4(d)
rule. The construction work may require the i�emoval of approsimately 3 trees (>3"dbh) uear N�e
bridge. To protect Indiana bats, any obstructing trees will be removed from October 15 to April
I S(winter clearing). W ith this measure, �ve recommend a"may affect, not lilcely to adverscly
affect" determination for Indiana bat.
Small whorled pagonia generally occurs in open, dry, deciduous �voods with acid soil, though
habitats can inclnde slopes along streams and mesic forest witli �vhite pine and rhododendron.
The nea��est record for tliis plaut is over 8 miles finm the project. Land nse adjacent to tlie bridge
consists of maintained road sl�oulders, a farm road, driveway, and pasture. There is wooded
habitat near the bridge, but this area is beyond where bridge consh•uction and gradiug work will
occur.
The Carolina northern flying squirrel, rock gnome lichen, spruce-fir moss spider and spreading
avens are found in spn�ce-fir forests and otlier isolated high elevation locations in western No�th
Carolina. However, rock gnome lichen is an exception because it can occasionally be found at
lower elevations in deep river gorges with high humidity or on some ve��tical rock faces that are
periodically wet. The bridge site has an elevation of only 2,480 feet and Iacks rock faces and
other habitat conditions required by these species.
The project is limited in scope. Erosion and sedimentation control measures �vill be implemented
to minimize adverse effects of the �vork on aquatic habitats. Habitats for listed species appear
lacking at the project site and noue of these species �vere observed during field visits. For these
reasons and those discussed above, �ve recommend that a detennination of "no effect" ou Iisted
species apply to this project, except for NLEB and Indiana bat as described above.
This project was reviewed by NCDOT's Human Environment Unit in 2011. Surveys were not
required for eitlier l�istoric architechu�e or archaeology �vith determinations of "no effecP' (see
attached forms).
NCDOT best management pr�ctices �vill be used to minimize and control sedimentation and
erosiou on this project The constniction foreman �vill review all erosion control measw�s daily
to ensure sedimentation and einsion controls are beiug effectively controlled. If the devices are
not fimctioning as intended, they will be replaced immediately with better devices.

Impacts to Waters of the United States
Arrington Branch (DWQ Class: C) is shown ou tlie USGS topographic map as a perenuiel stream.
The channel is approximately 8 feet in width and well defined with � substrate of mostly bedrock
tivith some sand, silt, and cobble. The sti�eam has sufficient flow to support fisl� and other aquatic
life. Arrington Branch flows to the Pigeon River. The Pigeon River meets the definition of a
Traditional Navigable Water (T'NW). For these reasons, we believe Arrington Branch is a
Relatively Permanent Water (RPW) and is under the jw•isdictiou of the U.S. Army Corps of
Engineers. In order to construct the project, it will be necessary to impact wate�s of the United
States in the French Broad River Basin (CU 060101�6). Specifically, NCDOT is requesting to
replace Bridge No. 314 with a bottomless concrete box culve�t. Listed belo�v is a sommary of the
proposed impacts.

The bottomless culvert was designed to meet the hydraulic needs of the site. This culvert will function as a bridge and
not impede or impair aquatic Ilfe passage (the scoured bedrock cascades in fhe stream channel at and downstream of the
bridge likely already impede fish movements). An off-site detour will be used to, in paR, reduce site disturbance.

All instream work will be performed in a dry work area using an impervious dike and diversion to divert lhe water around
the project site. Appropriate BMPs according to lhe approved erosion and sedimentation control plan will be installed on

This is a rural secondary road. The bridge is being upgraded to standard load limits and width to improve safety for the

1. The Corps of Engineers believes that there may be jurisdictional waters of the
United States on the subject site, and the permit applicant or other affected party
who requested this preliminary JD is hereby advised of his or her option to
request and obtain an approved jurisdictional determination (JD) for that site.
Nevertheless, the permit applicant or other person who requested this
preliminary JD has declined to exercise the option to obtain an approved JD in
this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or
a Nationwide General Permit (NWP) or other general permit verification requiring
"pre-construction notification" (PCN), or requests verification for a non-reporting
NWP or other general permit, and the permit applicant has not requested an
approved JD for the activity, the permit applicant is hereby made aware of the
following: (1) the permit applicant has elected to seek a permit authorization
based on a preliminary JD, which does not make an official determination of
jurisdictional waters; (2) that the applicant has the option to request an approved
JD before accepting the terms and conditions of the permit authorization, and
that basing a permit authorization on an approved JD could possibly result in less
compensatory mitigation being required or different special conditions; (3) that
the applicant has the right to request an individual permit rather than accepting
the terms and conditions of the NWP or other general permit authorization; (4)
that the applicant can accept a permit authorization and thereby agree to comply
with all the terms and conditions of that permit, including whatever mitigation
requirements the Corps has determined to be necessary; (5) that undertaking
any activity in reliance upon the subject permit authorization without requesting
an approved JD constitutes the applicanfs acceptance of the use of the
preliminary JD, but that either form of JD will be processed as soon as is
practicable; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps
permit authorization based on a preliminary JD constitutes agreement that all
wetlands and other water bodies on the site affected in any way by that activity
are jurisdictional waters of the United States, and precludes any challenge to
such jurisdiction in any administrative or judicial compliance or enforcement
action, or in any administrative appeal or in any Federal court; and (7) whether
the applicant elects to use either an approved JD or a preliminary JD, that JD
will be processed as soon as is practicable. Further, an approved JD, a proffered
individual permit (and all terms and conditions contained therein), or individual
permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331,
and that in any administrative appeal, jurisdictional issues can be raised (see 33
C.F.R. 331.5(a)(2)). If, during that administrative appeal, it becomes necessary
to make an official determination whether CWA jurisdiction exists over a site, or
to provide an official delineation of jurisdictional waters on the site, the Corps will
provide an approved JD to accomplish that result, as soon as is practicable.
This preliminary JD finds that there "may be" waters of the United States on the
subject project site, and identifies all aquatic features on the site that could be
affected by the proposed activity, based on the following information:

A map review and site file search was performed at the O�ce of State Archaeology (OSA) on Tuesday,
September 6, 201 ]. No previousfy recorded archaeological sites were contained within the presently
defined APE, immediately adjacent to the APE, or within a ten or more mile radius of the project locale.
Moreover, no existing National Register of Historic Places (NRHP), State Study Listed (SL), Locally
DesignTted (LD), Determined Eligible (DE), or Surveyed Site (SS) properties are located within or
adjacent to the defined APE and project study area. Topographic maps, USDA soil survey maps (CxA),
historic maps, archaeological/historical reference materials and aerial photographs were inspected/utilized
by the cultural resource specialist to evaluate factors that may have led to prehistoric or historic
settlementloccupation within the APE and to assess the Ievel of erosive impacts and disturbances that may
have affected any potential resources contained within the project construction footprint.

The lack of existing archaeological resources in Hie area, the diminutive and restricted nature of the APE
and consh•uction effort (in-place replacement with no new location and an off-site detour), and the poorly
drained, frequently flooded, and largely hydic floodplain soils within the immediate replacement area
make it highly unlikely that any significant cultural resources would be contained within the construction
footprint of the proposed bridge replacement project. No further archaeological work is recommended for
this state-funded construction effort.

Review of HPO quad maps, HPO GIS information, historic designations roster, and indeYes was
undertaken on September 6, 2011. Based on this review, there are no existing NR, SL, LD, DE, or SS
properties in the Area of Potential Effects, which is 75' from the centerline either way and 300' from eacl�
end of the bridge. Current Ha}nvood County GIS/I'ax infonnation there is a property constructed in 1918
within the APE. One outbuilding, a pole slied, associated with the complex is within the acmal APE and
will not be affected by the bridge replacement. The 1918 house and related outbuildings will not be
affected by this project. There are no other structures within the APE. No Survey is required. In
addition, Bridge NO. 314 is not NR eligible based on the NCDOT Historic Bridge Inventory.
