Dear Mr. and Mrs. Haimbaugh:
On December 19, 2007, the Division of Water Quality (DWQ) received your after-the-fact
application dated December 17, 2007, regarding your request for a Variance from the Catawba
Buffer Rules (15A NCAC 213.0243) for the subject property. On January 9, 2008, the DWQ sent
a letter to your attention requesting the additional information below:
1. This Office believes that the impacts to the protected riparian buffer can be avoided. Please
submit a restoration/seeding plan for the square footage of the beach and volleyball court in
the protected 50-foot riparian buffer
For this reason your permit application is hereby considered returned. Once you have redesigned
your project to address the problems and inadequacies with your application as it was submitted,
you will need to reapply for DWQ approval. This includes submitting a complete application
package. If you do not reapply with DWQ, your beach and volleyball court at the subject
property will be violation and enforcement action will be pursued.
Please be aware that you have no authorization under Section 401 of the Clear Water Act or
under the Catawba Buffer Rules (15A NCAC 2B.0243) for this activity and any further work
done within the riparian buffer or waters of the state would be a violation of North Carolina
General Statutes and Administrative Code. Please call Ms. Cyndi Karoly or Ms. Amy Chapman
