REQUEST FOR MORE INFORMATION
Dear Mr. Paton:
On August 25, 2006, the Division of Water Quality (DWQ) received your application dated August 26,
2006, to impact 0.365 acres of wetland (0.126 acres permanent impact, 0.239 acres temporary impact), 91
linear feet of stream (71 linear feet temporary perennial stream impacts, and 201inear feet temporary
intermittent stream impacts), and 8,155 square feet (ftZ) of protected Zone 1 Neuse River basin riparian
buffer and 5,058 square feet (ft2) of protected Zone 2 Neuse River basin riparian buffer to construct the
proposed multiuse project. The DWQ has determined that your application was incomplete and/or
provided inaccurate information as discussed below. The DWQ will require additional information in
order to process your application to impact protected wetlands and/or streams on the subject property.
Therefore, unless we receive the additional information requested below, we will have to move toward
denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as
incomplete until we receive this additional information. Please provide the following information so that
we may continue to review your project.
Additional Information Requested:
1. Use of wetland detention ponds followed by level spreaders and a forested filter strip would be
acceptable stormwater treatment in accordance with the Neuse River buffer rules. On some of the
site plans (for instance, Sheet 4), this design is clearly shown. However, on other site plans (for
instance Sheet 1), a wet pond is shown, but the level spreader and forested filter strip are not
labeled. Please amend your site plan to label all proposed level spreaders and forested filter strips.
In addition, we will need worksheets for each level spreader so we can be certain that they are
properly sized. Finally, please provide a signed and notarized operation and maintenance
agreement for the ponds and level spreaders.
Please respond within three weeks of the date of this letter by sending this information to me in writing
and Eric Kulz of the DWQ Raleigh Regional Office. If we do not hear from you within three weeks, we
will assume that you no longer want to pursue this project and we will consider the project as withdrawn.
