Subject: Lowes Bldg. Supply Site, Hwy 16/Hwy 150 Interchange
Dear Mr. Crosby:
The Division of Water Quality (DWQ) received your application fora 401 Water Quality Certification
for the subject project on January 14, 2008. In addition to the 262 feet of stream impact, 0.425 acre of
wetland (45% of total) is proposed for fill.
I have reviewed the application and have visited the site. I noted that the stream is located in a well-
forested area with well-characterized geomorphology. Stream width at top of bank is approximately 6 ft.
Channel depth is approximately 5 ft. Stream substrate is sandy/gravelly/cobble. Minnows were observed
in pools of the stream. Based on my site visit and review of the application the following
information/comments are needed by this office in order to complete our review:
a) The application failed to have an authorized signature. Please submit the proper signature or
an agent authorization form for the project. In addition, please provide information of the
owner (name, title, address, etc.).
b) The application states that there are six alternative "floor" plans. Do any of the floor plans not
impact the stream? Please provide plans (site diagrams) and reasons for those not selected.
c) It is assumed that the floor plans did not include construction of the site without out parcels
(alternative #7). The application states that the project is not financially feasible without the
out parcels. Please provide information/documentation/data supporting this comment. The
stream impact and wetland impact can be greatly reduced with the removal of the out parcels,
while still allowing for the construction of the facility.
d) Please provide a letter of acceptance from the NC Ecosystem Enhancement Program for the
proposed impacts.
e) Please provide copies of the stream and wetland data forms.
f) Please provide construction details for the stream impact (cross sections, profiles, longitudinal
profile). Stream impacts associated with culvert installation and riprap should be identified.
Pursuant to 15A NCAC 2H .O5O7(h), please be advised that this project will be placed on hold.
Failure to submit the requested information by February 8, 2008 will result in the application being
withdrawn from consideration. You may reapply, but a new fee and application will be required. In
addition, this office is requesting that the Army Corps of Engineers withhold processing the 404 permit
until the requested information is provided.
