There is a temporary stormwater measure for Tract 6 that was required as part of the original 401 approval. I'm attaching
an unsigned copy of that permit for your review. I'll need ta address Condition #4 in the attached permit and put it into
the existing permit and want to be sure Clemmons is aware of that responsibility or can provide some other means of
addressing it. Can you comment on that please.
I'm heading to the field right now and will be back in the office this afternoon and tomarrow afternoon.

Currently the Village owns and maintains the existing portion of Village Point Drive. The Stormwater Pond which treat this
section of the road is owned and maintained by Novant. Please call me if you have any additional questions or need more

It is Novants responsibility to maintain the sediment basin also. ludy has contacted Kelway with Stimmel Associates to
schedule an inspection to determine any items which need to be addressed. The Village will assure the basin is
maintained under our Phase II program. Call me later this morning when you get a chance. My cell number is 293-3839.

The village does have the authority through the Phase II program to address any issues with the Novant pond. On an
annua) basis, Novant provides us an inspection report. We review their report, compete our own inspection, and either
agree or pcovide comments of iterns which need to be resolved. We can imposed fines until any deficient issue are
corrected.

Can you also confirm if the Village has the autharity through the Phase II program to address any 0&M issues for the
Navant site? Since it wasn't permitted through the local Phase II program I wasn't sure if you have legal authority to
enforce the local program conditions.
