Mr. Blackmon,
Aside from the EEP extension letter, I have not received any of other the
information requested in the attached e-mail. (map, response to isolated wetland
question etc).
I have managed (through the patience of Ian McMillan) to keep this file open far
longer than usual while we worked on resolving these questions.
However, it is now on the brink of being returned as incomplete. In order to keep
this from happening, and further delaying the process,
we ask that you please provide this info as quickly as possible.
If it is not received by January 25th, the entire application will be returned.

As we just talked about on the phone, I have the following questions:
Do you have plans that demonstrate that lots 66, 67, 192, 193,194, 206, 209, 21,
and 211 can be developed without impacting the isolated wetlands as depicted in the
401 application? If it is necessary to impact these non-404/401 wetlands, it will be
necessary to obtain a separate isolated wetlands permit. This may also require
additional mitigation. Unauthorized impacts to these isolated wetlands would
constitute a violation of specific isolated wetland rules.
I understand that EEP has contacted you about the expiration of their commitment to
provide mitigation for this project. Please let us know that the 2:1 mitigation
proposal we discussed is still an option with EEP and that your company will satisfy
that mitigation requirement. As we discussed on the phone, I had some confusion as
to the actual acreage this project would impact. After further review, it appears
that the total 401 impact requested is in fact 0.886 acres (0.712 ac for roads,
0.110 for driveways, and 0.064 for lot development). At 2:1, this would require

1.772 acres of mitigation. Please ask EEP to provide a commitment for that acreage.
Finally, we ask that a detailed map be provided that indicates all of the proposed
impacts, including roadways, driveways, and lot development fill. (This may have
already been provided to the Central office group. However, I do not have one, and
need one for compliance purposes.
Hopefully, provision of this information will satisfy any remaining questions.
