Dear Mr. Bailey and Ms. Homewood:
Mr. Robin Team of Carolina Investment Properties, Inc. (the applicant) received a letter dated
March 29, 2016 from the North Carolina Department of Environmental Quality -Division of
Water Resources (NCDEQ-DWR) requesting additional information to process the 401 Water
Quality Certification associated with the U.S. Army Corps of Engineers (USACE) Nationwide
Permit 39 Verification for the proposed Qorvo facility located north of Thorndike Road in
Greensboro, Guilford County, North Carolina. The letter indicates that the USACE received the
Nationwide Permit verification request on February 29, 2016. The purpose of this letter is to
provide the NCDEQ-DWR the requested information.
NCDEQ-DWR Comment 1): According to the parcel information provided in the application, the
current owner of the parcel is NAME. Pursuant to 15A NCAC 02H .0502(f), when the applicant
(NAME) does not have title to the property, documentation must be provided that the
applicant has been authorized by the owner to apply for a certification. Please provide that
documentation.
Applicant Response: Pursuant to 15A NCAC 02H .0502(f), the current owner of the proposed
site parcels have provided permission to the applicant, Carolina Investment Properties, Inc. to

apply for a 401 Water Quality Certification in a letter dated March 25, 2016. A copy of the
letter is included as an attachment.
NCDEQ-DWR Comment 2): Please provide the Division a copy of your response to March 17,
2016 letter from the U.S. Army Corps of Engineers requesting additional information. [15A
NCAC 02H .0502(c)]
Applicant Response: The NCDEQ-DWR has been previously provided with the applicant's
response to the USACE request for additional information in a letter dated March 28, 2016.
NCDEQ-DWR Comment 3): Please provide a Jordan Lake Buffer Authorization or Variance from
the local delegated municipality to document that impacts to the protected riparian buffer are
in accordance with the approved local ordinances. [15A NCAC 02B .0267(7)(b)]
Applicant Response: Pursuant to 15A NCAC 02B .0267, the applicant submitted a request of No
Practical Alternatives to the City of Greensboro in a letter dated February 22, 2016. It is the
applicants understanding that the City of Greensboro is in the process of reviewing the
submitted information and no such time frame has been provided when final review will occur.
Therefore, the applicant requests that the NCDEQ-DWR issue a 401 Water Quality Certification
for the project with the condition that impacts will not occur until Buffer Authorization has
been obtained from the City of Greensboro and provided to the NCDEQ-DWR. The applicant is
aware that if during the City of Greensboro's review of information, if changes are proposed to
the project design, then there could be a potential requirement of a 401 modification,
subsequent 401 review fees and subsequent length of time for NCDEQ-DWR to review the 401
modification.
NCDEQ-DWR Comment 4): Please provide a copy of the locally approved stormwater
management plan with proof of approval. [15A NCAC 02H .0506(b)(5) and (c)(5)]
Applicant Response: The applicant is in the process of seeking stormwater approval from the
City of Greensboro. However, it is not clear the time frame which stormwater approval will be
obtained from the City of Greensboro. Therefore, the applicant requests that the NCDEQ-DWR
issue a 401 Water Quality Certification for the project with the condition that impacts will not
occur until Final Stormwater Approval has been obtained from the City of Greensboro and
provided to the NCDEQ-DWR. The applicant is aware that if during the City of Greensboro's
review of information, if changes are proposed to the project design, then there could be a
potential requirement of a 401 modification, subsequent 401 review fees and subsequent
length of time for NCDEQ-DWR to review the 401 modification.

Based on the above information, it is our opinion that the applicant has fulfilled and provided
the above requested information for the NCDEQ-DWR to proceed with issuance of the 401
