This is a courtesy copy for DWR. NCDOT previously committed to a tree clearing moratorium from May 15-August 15 as a conservation measure to avoid disturbing potential Northern long-eared bats in their summer roosting habitat under the 'Interim 4d rule'. See attached concurrence letters. However, with the issuance of the 'Final 4d rule', NCDOT will no longer meet the moratorium. Thus, for the proposed action, NCDOT has committed to the conservation measures listed below: 1) No alterations of a known hibernaculum's entrance or interior environment if it impairs an essential behavioral pattern, including sheltering Northern long-eared bats (January 1 through December 31); 2) No tree removal within a 0.25 mile radius of a known hibernacula (January 1 through December 31); and 3) No cutting or destroying a known, occupied maternity roost tree, or any other trees within a 150-foot radius from the known, occupied maternity tree during the period from June 1 through and including July 31. NCDOT has determined that the proposed action does not require separate consultation on the grounds that the proposed action is consistent with the final Section 4(d) rule, codified at 50 C.F.R. § 17.40(0) and effective February 16, 2016. Section 7 responsibilities are therefore considered fulfilled. This framework allows federal agencies to rely upon the U.S. Fish and Wildlife Service's (USFWS) January 5, 2016, intra-Service Programmatic Biological Opinion (BO) on the final 4(d) rule for the NLEB for section 7(a)(2) compliance by: (1) notifying the USFVJS that an action agency will use the streamlined framework; (2) describing the project with sufficient detail to support the required determination; and (3) enabling the USFWS to track effects and determine if reinitiation of consultation is required per 50 CFR 402.16. This form is not necessary if an agency determines that a proposed action will have no effect to the NLEB or if the USFWS has concurred in writing with an agency's determination that a proposed aetion may affect, but is not likely to adversely affect the NLEB (i.e, the standard infonnal consultation process). Actions that may cause prohibited incidental take require separate formal consultation. Providing this information does not address section 7(a)(2) compliance for any other listed species. WBS no.17BP.9.R.12. As of Apri12, 2015, the northern long-eared bat (Myotis septentrionalis; NLEB) is listed by the U.S. Fish and Wildlife Service (USFWS) as "Threatened" with an Interim 4d rule including Rowan County within NCDOT Division 9 (http://www.fws.gov/raleigh/species/cnrylisUnc_counties.html). The project involves a 404 permit and state funds and is subject to Section 7 of the Endangered Species Act. Using USGS mines shapefile dataset, a desktop assessment was conducted for any mines within one half mile of the project azea. No mines were shown in the azea. Therefore, no mines needed to be checked on foot. In addition, no known caves are in the area for the project. Based on the lack of mines and caves, no winter habitat will be affected by the project. There aze no manmade dwellings of suitable habitat that are proposed to be removed in the project area. The project involves replacing an existing bridge with a metal deck, metal guard rails and timber end walls. concrete deck, concrete end walis, and concrete guard rails. The bridge was surveyed for presence of bats or evidence of bats, and neither was found. Thus, no shvcmre moratorium will be implemented on the project. According to the North Cazolina Natural Heritage Program (NHP) Biotics Database, most recently updated in Apri12015, NLEB have not been documented in Rowan County. However, a rabies lab record that lacks specific location information exists for Davidson County in Division 9. The closest specifically documented occurrence ofNLEB is in Wilkes County (NHP 2001 mist net record), more than 50 miles of any of the project sites. Potential summer roosting and foraging habitat in the form of forested areas interspersed with fields, and water sources do exist in or around the project. The project area involves minimal tree clearing. NCDOT commits to a tree clearing moratorium in the project area from May 15 to August 15 of any calendar year to avoid disturbing potential Northern long-eared bats in their summer roosting habitat. As requested by the North Carolina Department of Transportation (NCDOT) in your letter of July 13, 2015, we have reviewed the natural resources information and biological conclusion with regard to the federally threatened northern long-eared bat (NLEB) (Myotis septent�ionalis) for the subject project. The proposed project includes replacing Bridge No. 147 on SR 2541 (Klumac Road) in Rowan County, North Carolina. We provide the following comments in accordance with the provisions of section 7 of the Endangered Species Act of 1973, as amended �16 u.s.c. 1 s31-1 s43� �a�t�. Habitat for the NLEB exists along the project corridor and has been evaluated for potential impacts from project implementation. According to the information provided, no caves or mines were found from a desktop search conducted for the project footprint and within one-half mile of the project. The only structure that will be demolished was checked for bat use and none was observed. The closest summer record for the NLEB is more than 50 miles fram the project vicinity. Potential summer roosting habitat (in the form of forested patches interspersed with farm fields) does exist within the project area, and some trees will be cleared during project implementation. Based on: (1) the negative surveys for wintering habitat, (2) the fact that no sign of bat use was found during structure surveys, and (3) a commitment by the NCDOT to conduct minimal tree-clearing and their agreement to a tree-cutting moratorium between May 15th and August 15th (of any year) for the subject project, we agree that implementation of this project is "not likely to adversely affecY' the NLEB in the project area. In view of this, we believe the requirements under section 7(c) of the Act are fulfilled. However, obligations under section 7 of the Act must be reconsidered if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered, (2) this action is subsequently modified in a manner that was not considered in �his review, or (3) a new species is listed or critical habitat is determined that may be affected by the identified action.
