PROJECT DESCRIPTION The project site is located at 1085 B-Var Road, on the mainland side of Holden Beach, Brunswick County, NC. To get to the site from Wilmington take US Hwy 17 S to NC Hwy 211. Turn left onto NC Hwy 211 and travel approximately 0.3 miles to Stone Chimney Road. Turn right onto Stone Chimney Road and travel approximately 7.3 miles to B-Var Road. Turn left onto B-Var Road and travel <0.1 miles to the project site, which is located on the right. The subject property consists of a commercial tract of land, approximately 0.49 acres in size with approximately 185 linear feet of shoreline frontage. The property is bordered by a vacant commercial tract of land to the west, B-Var Road to the north, a commercial marina to the east and the Atlantic Intracoastal Waterway (AIWW) to the south. The property measures approximately 255' in depth measured from Normal High Water (NHW) by approximately 100' in width. The property has an average elevation of approximately 6' above NHW. There is an existing two story residential structure located on the north side of the property and the remnants of an old rail system located on the southeast side of the property. Upland vegetation consists of lawn grasses, small Pine trees (Pinus sp.), Wax Myrtle (Myrica cerifera) and several landscaping plants. Disticlis (Disiticlis spicata) is found in the lower elevations of the yard and transitions to Salt Meadow Cordgrass (Spartina altern~ora). The tract is zoned CLD (Commercial Limited Development) by Brunswick County, and the area is presently a mix of residential and commercial uses. The Brunswick County Land Use Plan classifies the upland areas of this prof ect as Transitional. The waters of the AIWW have been classified SA, HQW by the NC Division of Water Quality and are OPEN to the taking of shellfish in the prof ect area. The area is not considered to be Primary Nursery Area by the Division of Marine Fisheries. PROPOSED PROJECT: The applicant proposes to replace an old boat rail system with a boat ramp, construct a 5-slip docking facility, dredge the basin, install an infiltration stormwater system, driveway and vehicle turn around area. The applicant states that the existing two story residential structure is to remain. The applicant is proposing to construct a 5-slip docking facility, which would consist of an access pier measuring approximately 5' in width by 37' in length (see Sheet ES of 11). There would be a metal access ramp measuring approximately 3' in width by 16' in length, which would connect the pier to the proposed floating dock. The access ramp would connect to a floating platform measuring approximately 5' in width by 20' in length on the east side of the docking facility adjacent to the proposed boat ramp. As proposed there would be a floating dock measuring approximately 4' in width by 39' in length extending in an easterly direction from the center of the access ramp-landing platform. There would be another floating dock measuring approximately 4' in width by 73' in length located on the western end of the previous floating structure and would extend in a southerly direction into the waterbody. There would be two finger piers located in the middle of this floating dock on the eastern side, each measuring approximately 2' in width by 20' in length and extending in an easterly direction. As proposed the boat ramp would be installed at a 14° slope into the waterbody (see Sheet E6 of 11). Adjacent to the boat ramp on the western side the applicant is proposing to install a wooden retaining walUbulkhead which would measure approximately 18" in width by 30' in length and would be aligned an average of 2.5' waterward of NHW. The wall would be located between the boat ramp and the access pier. No pump out, fuel-handling or overnight services are proposed. The applicant is also proposing to excavate an area measuring approximately 130' in length by 100' in width to a final depth of ~' to -10'@ Mean Low Water (MLW) for the entire boat basin (see Sheet E3 of 11). An area measuring approximately 56' in length by 20' in width with a final depth of -3'@ (MLW) would be excavated for the boat ramp area. The proposed excavation would include approximately 590 sq. ft. of coastal wetlands predominately Salt Meadow Cordgrass (Spartina altern~ora) which the applicant is proposing to relocate to an area on the west side of the access pier, which is also shown within the dredging limits. In addition, approximately 722 sq. ft. of §404 wetlands will be removed for the boat ramp installation. A total of approximately 1,185 cubic yards of material would be removed. The excavation would be accomplished by bucket and barge for the waterward half of the dredging. An excavator with a 60' reach would be used to excavate the remainder of the project area. The applicant states that all spoil material be would loaded into sealed dump trucks at the site and transport the spoil material to the landfill located at 172 Landfill Road NE in Bolivia, which is approximately 5 miles away. The applicant is also proposing to construct a gravel driveway and turnaround area for boat launching vehicles (see Sheet E5 & E6 of 11). As proposed the driveway entrance would be located on the eastern side of the property and would measure approximately 20' in width by 110' in length and would terminate in a turnaround circle measuring approximately 80' in diameter at the boat ramp. 10. ANTICIPATED IMPACTS The proposed retaining wall bulkhead would result in the filling of approximately 9 sq. ft. of Coastal Wetlands. The new docking facility and associated slips would result in the incorporation of approximately 2,021 sq. ft. of estuarine waters and public trust area. The proposed docking system would extend approximately 83 feet into a waterbody, which measures approximately 360 feet across. This distance would conform with the 1/4 width rule and the established pier lengths and would not encroach into the U.S. Army Corps of Engineers 80-foot setback from the AIWW (see Sheet E2 of 11). The proposed structures would not encroach into the 15' riparian corridor setback. The applicant states that this docking facility is designated for five (5) slips however, considering the proposed dredging associated with this project and dock configuration, it appears that it would potentially accommodate as many ten (10) slips. This will result in a 46.7% impervious surface coverage within the AEC. Minor increases in turbidity should be expected, but if construction is timed to avoid periods of peak biological activity impacts should be minimal. The application states that a stormwater infiltration system will be installed however no plans for this system were submitted. The applicant has obtained a Stormwater permit #SW8061034 issued to Red Apple Group, LLC on Apri118, 2007. The applicant states they were also issued an EA/FONSI - SCH#07-E-4300-0227 on February 14, 2007. An old boat rail ramp is located on the east of the property. Based on discussions with the current residents, they believe the boat rail ramp was functional about 15 years ago. The property to the east is a commercial marina with boat repairs, hoist, and mooring facilities. The property to the west provides mooring facilities for commercial fishing vessels. Proposed Uses The existing home will remain. as is. The owner proposes to restore and improve the existing boat ramp and add a "day" mooring facility. The facilities will be for the exclusive use of an inland homeowner's association. No pump out, fuel-handling, or overnight services will be provided. Signs will be installed prohibiting disposal of boat trash, fish offal, and sewer discharge. The proposed floating docks, finger piers, and pilings will be made of wood. The proposed boat ramp will mimic the existing boat rail ramp location. Five day mooring slips will be provided for boats ranging in size from 25' to 30'. Dredging Mechanical dredging will occur with the use of a clam shell bucket. The crane can reach 60', so half of the dredging will occur from the upland area. The other half of the dredging will occur from a barge. The barge is transportable by tractor trailer. The tractor trailer will offload the barge at the existing boat rail location utilizing mats. The dredge material will be offloaded to sealed dump trucks. The dump trucks will use the mats which were previously installed for the tractor trailer. Three 19 CY dump trucks will be utilized making multiple trips to the landfill s miles away. The landfill has been contacted and will accept wet material. 1185 CY of material will require approximately 66 trips with wet material. The 404 wetlands and mooring concept have been approved by Henry Wicker of the US Army Corps of Engineers. The coastal wetlands have been approved by Caroline Bellis of the Division of Coastal Management. The normal high water line was flagged by Debra Wilson of the Division of Coastal Management in July 2007. The proposed plan includes debris removal and marsh restoration of approximately 255 square feet of wetlands. The 590 square feet of coastal marsh impacted by expansion of the boat ramp will be mitigated with 600 square feet of replanted coastal marsh. A shellfish survey was conducted in August 2006 indicating shellfish resources were not present. The proposed boating facility will require stormwater treatment. Stormwater will be treated through an infiltration system. A Stormwater Permit was issued April 18, 2007. A ramp retaining wall will be constructed to accommodate the slope of the ramp and provide boardwalk access to the mooring facilities. The ramp retaining wall will extend from elevation 5 down to elevation -0.5 and run along the side of the boat ramp with the boardwalk. Impacts have been minimized inside the 30' buffer to water-dependent uses per 15A NCAC 07H.0208 Use Standards. There is no safe alternative location outside the buffer for the turnaround. The turnaround has been designed to the minimum 80' diameter to accommodate boat trailer backing. Time-saver Standards for Landscape Architecture states in the Launch Facility design guidelines "The backing up of a vehicle [with boat trailer] should be limited to 200 ft and the maneuvering area should be at least 80 ft, and preferably 100 ft, in diameter." The 80' diameter turnaround was evaluated as part of the Environmental Assessment. A FONSI (Finding of No Significant Impact) was issued on February 6, 2007.
