The proposed project is included in the approved 2016-2025 State Transportation Improvement Program (STIP). The location is shown in Exhibit 1. NEPA/404 MERGER PROCESS DOCUMENTATION The project is federally funded and is subject to the National Environmental Policy Act (NEPA) of 1969, and has followed the NEPA/Section 404 Merger process. A Merger Screening Meeting was conducted on July 17, 2014 and it was detennined the project would enter the Merger Process at Concurrence Point 2A (CP 2A). The CP 2A meeting was held at the Division 4 Johnston County Maintenance Yard on November 18, 2015. Concurrence has been reached on CP 2A. PROJECT PURPOSE AND NEED The purpose of the project is to improve the safety and mobility of vehicular travel along US 70 within the project limits. The proposed project is intended to address the following needs: Safe Detailed crash data was collected within the project study limits between May 2009 and April 2014. The data indicates 137 crashes occurred within the project limits during this time period. Two of those crashes resulted in fatalities. One other crash resulted in serious injuries to two people. Table 1 provides a comparison of the crash statistics within the project study corridor and similar statewide facilities. The analysis indicates the fatal crash rate far the subject section of US 70 is higher than the statewide average far similar facilities. W-5600 — Merger Application March 2016 The crashes are distributed along US 70 throughout the project limits, with clusters of crashes at most intersections. According to overall crash location data for Johnston County, sections of US 70 through the project limits are among the county's highest frequency crash locations. Twenty seven percent of the crashes in the project area resulted in injuries. Rear-end slow or stop crashes were the most common crash type, accounting for approximately 27 percent of crashes along this section of US 70. Most of these crashes occurred in proximity to the US 70 intersections with Swift Creek Road and Wilson's Mills Road. Rear-end slow or stop crash types are an indicator of congested conditions and/or turning movements and represent the effect such conditions can have on driver behavior. Rear-end accidents typically occur where unexpected traffic queues force sudden stops, at signalized intersections during signal-phase changes, and when drivers are distracted. The two traffic signals within the project limits are a concern, given the high speed traffic and free-flow nature of adjacent sections of US 70. Drivers, especially after travelling along freeway sections, sometimes do not expect traffic signals on rural four-lane highways such as US 70. Much of the traffic on US 70 in the project area is long distance, intercity traffic. During the suuimer, US 70 is heavily traveled by beach goers. The section of US 70 in the project area is an expressway with partial control of access, while the portion of the project to the west is a freeway with full control of access. For eastbound tra�c on US 70, the traffic signal at Swift Creek Road is the first signal encountered in approximately 19 miles. For westbound traffic on US 70, the traffic signal at Wilson's Mills Road is the first signal encountered in approximately 7.4 miles (this will be the first signal in approximately 13.1 miles following completion of STIl' Project W-5107, which is under construction and will convert the next signalized intersection on US 70 east of Wilson's Mills Road to an interchange). Traffic safety studies indicate closing at-grade intersections and replacing them with interchanges may reduce total crash potential by as much as 42 percent and injury crashes by as much as 57 percent. �Mobility ' T'he existing traffic signals along the subject section of US 70 result in delay to traffic. In addition, the speed limit�can only be set to 55 MPH because of the at-grade intersections. The speed limit of the adjoining freeway section of US 70 to the west is 70 MPH. In the year 2035 without construction of the proposed project, it will take an average of approximately six minutes to travel the 4.7 mile section of US 70 within the proj ect limits. Following construction of the proposed interchanges and removal of at-grade intersections along this portion of US 70, the speed limit can be raised to 70 MPH. In the year 2035 with construction of the proposed project, it will only take approximately 4 minutes to travel the 4.7 mile section of US 70 within the project limits. This is an approximately 33 percent reduction in travel time over the no-build alternative. The latest federal surface transportation reauthorization, entitled Fixing America's Surface Transportation Act or the "Fast Act" was signed into law in December 2015. The law designates US 70 from I-40 to the port at Morehead City as a future interstate. The improvements proposed as part of this project are an important component of this.overarching plan to upgrade the US 70 corridor. 2 W-5600 — Merger Application March 2016 COST ESTIMATES AND SCHEDULE Cost estimates for each alternative are presented in Table 2 below. Right of way acquisition is scheduled to begin in Fiscal Year (FY) 2018, and the construction is scheduled for FY 2020 in the 2016-2025 STIP. No Build Alternative The No Build alternative avoids impacts to resources within the study area. However, this alternative does not address the purpose and need of the project because it does not improve safety or mobility within the project study corridor. The project area will continue to experience crashes at the intersections. Also, US 70 will experience an increase in vehicular delay as traffic volumes rise, reducing mobility within the project study area. For these reasons, this alternative was eliminated from further consideration. 2. Alternate Modes of Transportation Mass transit is not available in this area of Johnston County because of lack of demand, low population density, diffused employxnent centers, and diversity of trip origins and destinations. US 70 serves local and regional traffic. For these reasons, mass transit will not capture the requisite number of person trips to make this alternative a reasonable and feasible alternative. The Mass Transit alternative would not meet the purpose and need for the project and was eliminated from further consideration. 3. Transportation Systems Management Transportation Systems Management (TSM) alternatives include low-cost improvements designed to maximize the utilization and efficiency of the existing system. TSM improvements involve increasing the available capacity of the facility within the existing right of way with minimum capital expenditures. Items such as the addition of turn lanes, striping, signalization, and minor realignments are examples of TSM physical improvements. Traffic law enforcement, speed restrictions, access control and signal timing changes are examples of TSM operational improvements. TSM alternatives would not provide the same level of safety and mobility improvement along US 70 as the proposed interchanges and access control and would not meet the project purpose and need. Therefore, TSM was not considered a reasonable and feasible alternative and was eliminated from further consideration. W-5600 — Merger Application March 2016 4. Improve Ea�isting Facility The Improve Existing Facility Alternative will upgrade US 70 within the project study corridor to a freeway. Interchanges are proposed to replace the existing signalized, at-grade intersections at SR 1501 (Swift Creek Road) and SR 1913 (Wilson's Mills Road). The non-signalized, at-grade intersections would also be eliminated. Full access control would be implemented along US 70 within the project limits. Access to adjacent properties would be maintained via service roads connected to the Swift Creek Road and Wilson's Mills Road interchanges. Detailed Study Alternatives Multiple designs for each interchange location were considered. These interchange options include service road options. The individual interchange options are shown in E�ibit 2. Swift Creek Road Interchange Options Swift Creek Road OpHon 1 is a half-cloverleaf design with Swift Creek Road shifted west on new location. This option includes ramps/loops in the northwest and southwest quadrants. The realigned Swift Creek Road would be bridged over US 70. Swift Creek Road Option 2 includes ramps/loops in the northeast and southwest quadrants. Swift Creek Road would remain on its existing alignment. Swift Creek Road would be bridged over US 70. 5wift Creek Road Option 3 includes ramps in the northwest and northeast quadrants and a ramp/loop in the southwest quadrants. Swift Creek would remain on existing alignment. Swift Creek Road would be bridged over US 70. Wilson's Mills Road Interchan�e O tp ions _ Wilson's Mills Road Option A is a tight diamond design with ramps in four quadrants. US 70 would be realigned to the south and bridged over Wilson's Mills Road. - Wilson's Nlills Road Option B is a half-cloverleaf design with ramps/loops in the northeast and southwest quadrants (similar to Swift Creek Road Option 2). Wilson's Mills Road would be bridged over US 70. Service Roads The project proposes full control of access along US 70 within the project limits. Service roads would ensure access from adjacent properties to US 70. Proposed service roads, from west to east, are: Service Road l, located on the north side of US 70 near the western project terminus, acts as a western extension of Uzzle Road. Service Road 1 will provide a connection to the east via Uzzle Drive and Service Road 3. (Service Road 3 connects to the western end of Wilson's Mills Road). This service road would provide access to an agricultural property currently accessed directly from US 70 opposite Sadisco Road. Service Road lA, located on the south side of US 70 provides access to Uzzle Industrial Drive properties, via an extension of Sadisco Road. W-5600 — Merger Application March 2016 Service Road 2, located on the south side of US 70 provides access to Uzzle Industrial Drive properties via a connection to Strickland Road to the east. Service Road 3 would extend Wilson's Mills Road to the west, providing access to agricultural properties and a nursery/landscape business on the north side of US 70. Service Road 4, located south of US 70, connects Strickland Road to Swift Creek Road and enhances connectivity provided by Service Road 2. The length of Service Road 4 would vary, depending on the Swift Creek Road interchange option chosen. Service Road 5 would realign the Twin Creek Road intersection with Swift Creek Road, located on the south side of US 70. This service road would be required for Swift Creek Road Interchange Option 2, but is not needed for the Swift Creek Road Interchange Option 1. Service Road 6 provides access to properties on the south side of US 70. Service Road 6 would extend from an existing service road west to Wilson's Mills Road. Service Roads 7, 8, 9,10, and 11 would connect the eastern-most segment of Bear Farm Road to Wilson's Mills Road on the north side of US 70. The combination of the service roads ensures access for businesses along Wilson's Mills Road Extension. Swift Creek Road Interchange Option 3 was dropped from consideration because it resulted in the highest amount of total wetland and stream impacts. Current Studv Alternatives Interchange Options Swift Creek Road 1 and 2 and Wilson's Mills Road A and B were carried forward for detailed analysis and combined into the detailed study alternatives described below in Table 4. Each alternative is a combination of one of the two Swift Creek Road interchange options, one of the Wilson's Mills Road interchange options, and the service roads. The locations of these streams are shown on Exhibits 4A & 4B. The physical characteristics and water quality designations of these streams are detailed in Table 6. Total avoidance of streams and wetlands by the project is not feasible. Throughout the development of the alternatives, NCDOT has attempted to avoid and minimize impacts to streams and wetlands to the greatest extent practicable. This includes the elimination of Alternatives 3A and 3B. At this time, no fmal decisions have been made with regard to the location or design of the preferred alternative. Compensatorv Miti�ation of Imnacts Once a final decision has been rendered on the location of the preferred alternative, NCDOT will investigate potential on-site stream and wetland mitigation opporhznities. If on-site mitigation is not feasible, mitigation will be provided by the North Carolina Department of Environmental Quality Division of Mitigation Services (DMS). The fmal detennination regarding any mitigation requirements rests with the US Army Corps of Engineers and the NC Division of Water Resources (NCDWR). North Carolina Buffer Rules Streamside riparian zones within the study area are protected under provisions of the Neuse River Buffer Rules administered by NCDWR. According to the Effective Flood Insurance Study (FIS) and Digital Flood Insurance Rate Map (DFIRM) obtained from the North Carolina Floodplain Mapping Program (MCFMP), Little Poplar Creek and Poplar Creek are currently located in Federal Emergency Management Agency (FEMA) Detailed Study Areas. RARE AND PROTECTED SPECIES Federallv Protected Species As of December 13, 2013, the United States Fish and Wildlife (iJSFWS) lists 4 federally protected species for Johnston County. Biological conclusions for federally protected species are shown in Table 11. There are no stands of pine within the project area having trees of the size and age required by the red- cocicaded woodpecker for nesting, nor is there appropriate foraging habitat. Mussel surveys were conducted in July 2014 within Little Poplar Creek, Poplar Creek and tributaries within 100 meters upstreain and 400 meters downstream from the project study area (Figure 1). No specimens of either mussel species were observed. The surveyed stream reachs were too small to provide habitat for the Tar River Spinymussel. These streams were also relatively poor quality dwarf wedgemussel habitat. Also, there were few other types of mussels in the areas surveyed. In general, both listed species are usually found in areas with substantial diversity and abundances of mussels. Given relatively poor habitat conditions, low diversity and abundances of 13 W-5600 — Merger Application March 2016 other mussel species and the distance to any NC Natural Heritage Program element occurrences for both species, it is anticipated the project will have "No effect" on either species. Suitable habitat for Michaux's sumac is present in the study area along roadside shoulders and utility easements. Surveys were conducted throughout areas of suitable habitat during June and July 2013 and October 2013. No individuals of Michau�c's sumac were observed. A review of North Carolina Natural Heritage Program (NCNHI') records, updated March 2016, indicates no known occurrence of any of these species within one mile of the study area. The bald eagle was declared recovered, and removed (de-listed) from the USFWS Federal List of Threatened and Endangered Species effective August 8, 2007. The bald eagle remains federally protected under the Bald and Golden Eagle Protection Act and the Migratory Bird Species Act. Mature forests and large dominant trees do not occur within the study area ar within a 1.13 mile radius (one mile plus 660 feet). A review of the NCNHP database in March 2016 showed no occurrences of bald eagle within two miles of the study area. Due to the results of the survey and lack of known occurrences, it has been deternuned this project will not affect this species. The US Fish and Wildlife Service has developed a programmatic biological opinion (PBO) in conjunction with the Federal Highway Administration (FHWA), the US Army Corps of Engineers (USACE), and NCDOT for the northern long-eared bat (NLEB) (Myotis septentrionalis) in eastern North Carolina. The PBO covers the entire NCDOT program in Divisions 1-8, including all NCDOT projects and activities. 'The programmatic detennination for NLEB for the NCDOT program is "May Affect, Likely to Adversely Affect." The PBO provides incidental take coverage for NLEB and will ensure compliance with Section 7 of the Endangered Species Act for five years for all NCDOT projects with federal nexus in Divisions 1-8, which includes Johnston County, where TIP W-5600 is located. CULTUI�AL RESOURCES The proposed project is subject to North Carolina General Statute 121-12(a), and Section 106 of the National Historic Preservation Act of 1966, as amended. Historic Architectural Resources Field surveys of the project's area of potential effect were conducted in February 2013. No properties listed on or eligible for the National Register of Historic Places were found. Archeolo�ical Resources Archaeological surveys were performed for the project in June and July of 2014. Eight archaeological sites were encountered. None of these sites are considered eligible for the National Register of Historic Places. SECTION 4(F)/6(F) RESOURCES Section 4( fl of the US Department of Transportation Act of 1966 specifies that publicly owned land from a public park, recreation area, wildlife and waterfowl refuge, and all historic sites of national, state, and local significance may be used for federal projects only if: a) there is no feasible and prudent alternative to the use of the land; and b) the project includes all possible planning to minimize harm to 4(� lands resulting from such use. 14 W-5600 — Merger Application March 2016 No properties protected under Section 4(� of the Deparhnent of Transportation Act, as amended, will be impacted by the proposed project. No public parks or recreation areas funded with Land and Wildlife Conservation Act funds were identified in the study area. Therefore, there is no impact to Section 6( fl resottrces. MINORITY/LOW INCOME POPULATIONS Title VI of the Civil Rights Act of 1964 protects individuals from discrimination on the grounds of race, age, color, religion, disability, sex and national origin. Executive Order 12898, "Federal Actions to Address Environmental Justice in Minority Populations and Low-Income Populations" provides that each federal agency shall make achieving environmental justice part of its mission by identifying and addressing, as appropriate, disproportionately high and adverse human health or environmental effects on minority and low-income populations. Non-white individuals comprise approximately 43 percent of the population of the census block group the project is within (Census Tract 409.01, Block Group 2), compared to approximately 22 percent of the population of Johnston County. These data indicate minority communities are present in the study area. However, the census block group is large and includes areas that are far removed from U5 70. Additional studies noted the potential for minority populations in subdivisions near the proposed Wilson's Mills Road interchange (northwest quadrant). In addition to the potential presence of minority communities, there is a presence of low-income residents. In the census block group, 28.2 percent of residents were below the poverty level, and 11.8 percent of residents were very poor (incomes less than 50 percent of the poverty level), compared to 16.1 percent and 6.2 percent, respectively, for Johnston County. During site visits, several additional areas with potential Environmental Justice populations were identified in proximity to the US 70 corridor. The Jones Court mobile home park (approximately 25 homes) is a potential low-income community with a potential minority population. The mobile home park is approximately 0.5 miles from the US 70 intersection with Swift Creek Road and would not be directly impacted by the proposed project. The Adelphos mobile home park, with approximately 6 homes, is on the north side of Sadisco Road. This mobile home park also includes a potential low-income population. The mobile home park would not be directly impacted by closure of the US 70 median opening at Sadisco Road. Convenient access to US 70 is also provided via US 70 Business. Public involvement and outreach activities must ensure full and fair participation of all potentially affected communities in the transportation decision-making process. A newsletter was mailed in May 2013, infonning area property owners of the start of project development studies for the proposed upgrade to US 70. A public meeting was held on February 2, 2016. The meeting was advertised in local media outlets, and newsletters announcing the workshop were mailed to area property owners. Through the public involvement efforts, citizens have been kept informed of the proposed project. Alternatives have� been developed and measures implemented to minimize impacts to the low- income and minority populations identified. This project is being implemented in accordance with Executive Order 12898. 15 W-5600 — Merger Application March 2016 PRIlVIE & IMPORTANT FARMLAND The Farmland Protection Policy Act of 1981 requires all federal agencies, their representatives, or those agencies receiving federal funding to consider the impact of land acquisition and construction projects on prime and important farmland soils. North Carolina Executive Order Number 96 requires all state agencies to consider the impact of land acquisition and construction projects on prime farmland soils, as designated by the US Natural Resources Conservation Service (NRCS). Land which is planned or zoned for urban development is not subject to the same level of preservation afforded other rural, agricultural areas. This policy does not apply to lands which are already in or committed to development proj ects such as water impoundment, transportation, and urban development. There are farmland soils located within the proposed project right of way of each of the current study alternatives. Farmland impacts for each alternative are shown in Table 7. A fmal Farmland Conversion Impact Rating (NRCS CPA-106) has not been completed for this project. Once a LEDPA is determined, a fmal Farmland Conversion Impact Rating will be calculated. . HA7.ARDOUS MATERIALS No hazardous waste sites, landfills, or other geoenvironmental concerns were identified within the project limits. � LOGICAL TERMINI/INDEPENDENT UTILITY The proposed project has logical ternuni and independent utility. The project involves upgrading existing signalized intersections to interchanges, removing the unsignalized at-grade crossings, and constructing service roads. The project limits are restricted to the area necessary to construct the interchanges and service roads and contain all approach work required to tie the project back into existing roadways. The proposed project will not restrict consideration of alternatives for other reasonably foreseeable transportation improvements in the area. This project would be a reasonable expenditure of capital even if no additional transportation improvements in the area were made.
